Subject: Visa appeal system
  Has anyone out there been denied and gone through the visa appeal system?

My boyfriend is sponsoring me for a permanent resident visa, and after a year thinking the process was going just fine, we got a letter saying it had been denied. He had already been approved as a sponsor and we had just been waiting for my stuff to work it´s way through the system.

We´re appealing the decision, but it seems to be taking forever also. We got copies of our applications back with a letter saying the next step would be a letter from them telling us when we can go in and schedule a hearing date. In the meantime we could gather more evidence and send it to them. That was about3 months ago and still no letter from them. We have no idea how long this is supposed to take or what the process will be like. :(

is your relationship common law, or conjugal?

appeal takes a long time. Is there any reason you would not want to get married? If not, the quickest way to resolve this is for him to marry you, and start the process again.

Conjugal relationship seem to be having a very tough time with approval.

dont appeal!!! reapply...the appeal will take about 1.5 years (that is the current time frame for national capital appeals)

it´s a conjugal relationship. We plan to get married eventually, but we wanted to do it after I can move so that we can do it together and in our own timeframe. We don´t want to get married just to get a visa, but it seems that´s the only advice we´re getting.

Sorry to hear about your plight SDgirl. My partner and I are going the conjugal route and reading your post has got me worried! Did you and your partner manage to spend much time together, and how long have you had your relationship? I can certainly sympathise with wanting to get married in your own time frame

We met online through a mutual friend and were friends for a couple months. Then I flew out to Vancouver and we hit it off. So we were in a fully committed relationship for a year before we decided to apply for a visa. During that first year, we had 6 visits with each other, mostly long weekends, one full week, plus we met each other´s family and friends. It took them a year to deny us a visa, so now we´ve been together for close to 2 1/2 years. You could say my patience is wearing thin now.

Why don´t you get a marriage licence and then do the wedding at your own timeframe? That´s what we are going to do. We decided that we will still be "engaged" for everyone around us (no name change, until the actual wedding). None of your friends needs to know if you don´t feel comfortable. No point to risk with the appeal.
