  Hello,

I have a serious concern and this is my case: I?m a canadian citizen sponsoring my husband who is currently resideing in US (not a citizen and no green card - student visa). They started processing (Buffalo) his application on Jan. 24/2005 and even though his FBI report and state reports were clear (no charges), he just received a letter from them telling him that:
1) NO INTERVIEW IS REQUIRED TO FINALIZE THE APPLICATION
2) ADDITIONAL DOCUMENTS REQUIRED (COURT REPORT, POLICE REPORT, AND MONEY THAT HE OWES TO THE COURT) REGARDING HIS DUI CHARGE FROM 2000.
I can?t believe it, but somehow they have doug out his DUI (with a minor accident) from 2000, which was deffered in the meantime, and for which he still owes about 10% and has the last court appearance in November. So, he has been paying everything on time, is done with the treatment, and has been behaving himself ever since. Plus, it?s been almost 5 years, and he was 19 years old at the time.
I contacted the CIC centre and after talking to the officer, he reassured me that have they taught that this could influence their decission that they would have asked for an intervire, and just advised me to send the required documents ASAP. In the letter, they said that they can?t finalize the application without these documents.

I am really scared, and he?s gone to the court to get everything and send it immediately. What do you think? I know that Canada is serious about DUI, but how does this sound to you? Do you think they will refuse his application?

Sharon,

Who do u think yourself to tell people when and how often to post their messages???? You sure got an attitude and you should get a grip ASAP

You get a grip.....people have to be patient....if the poster of the original message A. can´t wait 12 hours for a reply to a message, she will lose her mind waiting for CIC to get back to her about anything.

Usually what happens is that people post a message with a complex topic, like A.´s post and people have to think about it and maybe do some research.

Sharon is a good person on this board and she is not an expert but she does take time to look up info for people. This info she looks up can be accessed by everybody here....most questions posted here can be answered if the people look up the info themselves. Sharon doesn´t have to help but she does. Thanks Sharon.

Let´s all just get along and be patient in this process. We are all in the same boat. Let´s help not hurt each other.

Well Mr. Immigration Guy,

It is Sharon´s arrogant tone that is unacceptable. She could have said that comment in a more supportive manner, if her aim was really to help people.

I really suggest you send them what they ask for. I was in a similar situation, went to the interview and they wanted me to send them the police reports etc. As long as he was not convicted, generally there is no problem. An arrest is not considered a conviction, but they still want to make sure that everything is taken care of now. I send them the required docs. and everything was O.K.

our friend had her first reply within 10 minutes, the second reply within 6 hours. apparently that was not good enough... she posted the question again. Yes, she is entitled to do so, but as a participant of this forum, I do not like it when someone literally demands an answer in this manner. Since her second post she has 3-4 additional legitimate answers. not sure what else we can offer. Sometimes people need a chance to be helpful.

For Sharon (and everybody else who thinks the same), I appologized for posting the same question twice, but the only reason was because I wanted to post it with the subject ´DUI´ so people would automaticaly know what it´s about and everybody who´s had an experinece with DUI would hopefully reply. It wasn´t my intention to flood this forum, but I think that no one should tell people how many times and in what time intervals to post their questions anyway.
To Lila: thank you for sharing your DUI experience, and actually one thing that kind of calmed me down was the accompanying letter that the interview is not required. I´ve read so many documents regarding DUI and Canada immigration, and while it´s true that no one with DUI can enter Canada, again, my husband wasn´t convicted. His case was deferred, and he has been in compliance ever since, with no warrants or such, and both his state and FBI reports came back clear.
How long did it take them to send you PP after you submitted those documents?
