Subject: Really scared !
  Hello,

I have a serious concern and this is my case: I´m a canadian citizen sponsoring my husband who is currently resideing in US (not a citizen and no green card - student visa). They started processing (Buffalo) his application on Jan. 24/2005 and even though his FBI report and state reports were clear (no charges), he just received a letter from them telling him that:
1) NO INTERVIEW IS REQUIRED TO FINALIZE THE APPLICATION
2) ADDITIONAL DOCUMENTS REQUIRED (COURT REPORT, POLICE REPORT, AND MONEY THAT HE OWES TO THE COURT) REGARDING HIS DUI CHARGE FROM 2000.
I can´t believe it, but somehow they have doug out his DUI (with a minor accident) from 2000, which was deffered in the meantime, and for which he still owes about 10% and has the last court appearance in November. So, he has been paying everything on time, is done with the treatment, and has been behaving himself ever since. Plus, it´s been almost 5 years, and he was 19 years old at the time.
I contacted the CIC centre and after talking to the officer, he reassured me that have they taught that this could influence their decission that they would have asked for an intervire, and just advised me to send the required documents ASAP. In the letter, they said that they can´t finalize the application without these documents.

I am really scared, and he´s gone to the court to get everything and send it immediately. What do you think? I know that Canada is serious about DUI, but how does this sound to you? Do you think they will refuse his application?

my gut... they simply want to insure that the US charges are cleared before issuing the PR. If they were going to say no...you would have heard those words by now.

that´s what we taught initially because his case was deffered, and nothing appears on either his state or national report. The officer at CIC told me that whenever they find a DUI they will go to the bottom of it, but if they were able to find it, then they know everything pertaining to the dispossition of that incident..so I´m a little confused about them still asking for those documents.

It´s not DUL, it is D=driving U=under I=influence (of alcohol in this case)
