Subject: Reject my previous application.
  Dear Sir,
I filed canada immigration in 2001 with my spouse. Unfortunatelly, There was sepration (didn´t give her divorce)She lived with parent and I lived with my moom.
I intimated immigraton department this situation that day.
I recevied 1st interview call in 2004, I attended interview without spouse, and told to immigration officer, ´There is sepration in between´. She gave me maximum units in all factos, but gave 2 units in English ability & 2 Suitability,assessed only 60 units & refused my application in previous Act,and advised that, ´attend IELTS exam´
In between my ralation has done my spouse, so I filed New applicaton form with my spous including fee 550 dollars, & IELTS result. I also following assist and sent.
Education: 25 (M.A & LL.B) I passed Double Bechlore 16 years studied & 2 years more in Master, Total 18 years full time studied.

EXPERIENCE 21
AGE 10
SPOUSE EDUCA: 04
RELATIVE 05
TOTAL: 68
Immigration officer clled interviw & asked me,that,´attend interview with spouse must accompany, Weeding Certificate (with translate) & both all education certificate´.
We attended interview for all requirement,Immigration officer (She) took interview indviually, She said us, that ´I assesed your case, but I can´t give you 22 units in the education´,your total numbers are 65 units. I argued her that, you gave me maximu units in previous policy, & I also 18 years full time studied.
But, She said us, that again ´IELTS´ exam & your matter is pending to be decided by Federal court of Canada. I am waiting her reply yet.

I want know following Answer:
1. Can she refuse my previos application?(Has she violate fedeal court passed order in 2003?)
2. We filed 4 years ago & both deposited fee.
3. If, She would refused my application in Dual assessment
(We have already obtained 68 units)What can,We do in this situation?)
Note: I haven´t filed oput-out forum.
I hope, you will give me proper reply very soon.

friend, it is very hard to make sense of your posting. Unfortunately, your english skills are not very good.

If CIC requests documents or tests from you, it is in your best interest to supply them - especially the language tests. Otherwise you run the risk of having the Immigration officer assigning you a score that could be less than you deserve. You cannot dispute a language score.

CIC officers have the discression to accept or decline any application. According to the CIC website they can accept an application that shows less than 67 points and they can reject an application with 67 points if they feel the applicant will not be successful in their adaptation to Canada.

Your marriage, divorce situation is very confusing. If you are now divorced, or separated, you cannot include the woman in your application and cannot claim points for her.

To be very honest... the required points from CIC are for your benefit as well as Canada´s. CIC wants to make every effort to see that you have success in Canada. If you are not scoring 67 points, you can be sure your life in Canada will be a big challenge. Education without language is not worth very much. that is why they ask for your test.

I read your posting again. At your interview you were being considered under the old rules. (as per the rules of the court settlement). From the way I am reading your post...you were declined. CIC is now looking at your application under the NEW rules. They are suggesting that you are still short some points. They are giving you an opportunity to improve your score with the english testing. That is the only place you can gain some points.

I am not quite understanding your marital status
