Subject: International Student needs help
  I am a 24yr old male. I have a difficult situation, I came to canada on a student visa to do my graduate studies and when I arrived in Canada, I felt the program of study wouldn´t meet my career expectations. I didn´t start the program.

It is been one year now and I have not been involved in full-time studies, but at the same time I have been studying proffessional courses with a small academic training center. I have not worked in Canada illegally and I have supported myself since I came here.

The tricky situation is: My study permit and visa are expiring in 6 months from now and I don´t want to go back to my country, I would like to stay in canada. Some friends advise me to make refugee claim and stay here because in my country there is profound fear and pesercution for the homosexuals/gay people. But I do think I should marry my canadian girlfriend and submit a spousal application get the PR. Please could you advise me because am being stressed with this situation.

I desperately need help before I make some difficult choices. I will be grateful for any advise.

You say your Gay in one sentence and in need of protection. In the next sentence you have a girl friend! It´s people like you with BS refugee claims that slow the whole process down! Here is an idea for you! Apply the correct way! Don´t search for BS ways in the backdoor! Leve that for genuine refugee´s

You gay refugee claim will depend on factors such as the identity of the applicant as a homosexual man and the credibility of your story and the availability of state protection.

given your current status, a spousal PR application will be looked at with a microscope. If you apply inside Canada you will have no option to appeal. Not a great solution.

We are assuming Kay is a man. Kay may be a woman in a lesbian relationship.

Completely true - spousal PR application will be looked at with a microscope. They will be looking for every single thing, move, visit, picture, clothes...

The question would be if this person is in real need of protection!, if that is the case why this person didn´t become a refugee as soon as she put a foot on Canadian soil?
Why waited until now when her status is 6 months from expiring if she was indeed in need of protection?

Do you have any idea how many people apply as refugees within Canada with the story that they are in need of protection due to their sexual orientation? How many are actually successful?

VERY LITTLE! ALMOST NONE! Just based on that. They all claim that their government is hunting them down, in some cases is true in most of them isn´t.

So a refugee claim?, don´t even bother, that would give you a quick ticket to be removed from Canada.

As for your relationship, it is up to you to demostrate that it is indeed a genuine relationship, there is no appeal right with in-land applications and you will be under the microscope, a girlfriend suddenly becoming a "serious" relationship (marriage) now that your permit is going to expire along with a student visa that was not properly used other than to gain entry into Canada doesn´t put you in a good spot.

Anonymus, well I would like to submit a spousal application myself but I had a idea of friends who suggest to me that a refugee claim would be a wise decision, because they have taken that route and succeeded with their claims, well the honest truth is that, I´m in a relationship with my girlfriend and we have been together since I came here, I have evidence of that, we are planning to get married soon and then submit the spousal application, how is that?

DocD, well am more than confident to prove my relationship with my yet to be spouse and I do believe it is the be route to take, I really find your advise credible enough, well do you think an outland application would be the best way to go or an inland application and can I submit an outland application from inside canada?

Sharon, Kay is a man, well submitting a refugee claim based on sexual orientation was advise from a group of friends, but I didn´t buy the idea, I do believe I would stick to marrying my girfriend soon and submit a spousal application, she is more than ready to support the whole process because she doesn´t want me to go back home, I do love her and we are both from the same country, same background and we came here on the same time though she came as permanent resident and I did come on a student visa. Do you think I can have a good case?

Outland is a far better option than within Canada. You should apply outland but you have to be aware of three things here:

1- Likely you won´t get an extention of your permit while in Canada and you are going to have to leave Canada at the end of your permit, wait for your paperwork to go through and come back as a PR.

2- IF you are in Canada (let´s say that you were granted an extention) you still have to leave Canada go to your home country, submit your passport, get your visa and re-enter Canada as a PR.

3- During the process you may be called in for an interview and at that point you have to attend and likely you won´t be able to come back until the process is done.

Your best bet is send your application outside of Canada, leave Canada and come back as a PR. It is the best route. If things go sideways in the application, you can always appeal it as long as it is an outland application.

Outland applications are processed faster than in-land applications.

DocD, thanks so much for the advise, It really sounds great, well the worrying part is that If I do submit an out-land application and It is not approved, Is there any way I can come back?

I wouldn´t mind leaving before my current status expires but on the other hand, I wouldn´t love to spend a very long time away from my spouse. I do acknowlege that the outland is a better option but some reasons, I would take a chance on the inland understand there is no appeal and I will leave if it is not granted.

On the other hand, Is there a possibility that I might not be called to go back for the interview?
