Subject: separate divorce doc., illegal entry to canada
  I would like to have a couple questions answered in one post, if I may.

1. If marrying in another country and the marriage certificate states the person of that country is "divorced", is a "Separate" divorce certificate still required for sponsorship by a Canadian spouse?

2. Can an individual seek asylum if they´ve entered Canada illegally? And what is the process, if someone HAS entered Canada illegally, for dealing with this?

Well W Chick

1. It works like this. If your divorce is recognized by the country that issued it CIC will recognize that divorce certificate. No other certificate is needed.

2. If your already in Canada you can go into the In-Land office responsible for assessing eligibility to make same claim and make your refugee claim.

Well to some question 1 & question 2 may seem at opposite ends of the spectrum but please tell me your not up to doing anything possible to remain in Canada legally?

Spousal Sponsorship

Common Sense has to prevail if your in a real loving relationship go for it but if your not many that are in a loving relationship will get kicked for an interview because they will be suspected because of your bogus application. Proving a Bogus application gets harder all the time because too many are submitting bogus spousal applications.

Refugee Claim

You appear to be residing in Canada and want to make a refugee claim hmmmm. How many Days, Weeks, Months or YEARS have you been away from your home country were you have a WELL FOUNDED fear of persecution? Why did you not make your refugee claim the second you got safely into Canada at the Port of Entry? These questions will definitely be raised at your hearing if you ever get that far.

Now your issues may be two totally separate issues but when asked together they seem a desperate attempt and a willingness on your part to do anything to stay legally.

If I´m correct think for a second about all the others that will get hurt by your actions and the lack of odds you will not win as well.

The first question Does indeed pertain to me, personally. The second, more a curious inquiry for "someone else"... I am a Canadian citizen, born and raised.

What is meant by "well founded"? Fear of death, imprisonment, etc. in own country? But I´m not clear on something. If a person enters the country illegally, it is better to make a claim the moment one enters Canada, is that what I am to understand? But what happens next?

Consider this scene.

Government is trying to kill you because _____________. You hide out at your friends place but at 05:00 hrs government officials kick in the door and you escape out the back window with every cent you have.

You purchase a ticket and sneak onto a plane wearing a disguise. Fly to Canada and see a Canadian Government Official and you feel finally safe. Whew you made it.

Then you grab a Taxi and go visit Uncle Steve for three years.

You have been working and living in Canada safely for three years and then one day you decide to walk into a CIC Office and scream REFUGEE!!!!!

The sooner the claim is made the more believable the Refugee claim will seem.
