Subject: Confusion whether new or old rules apply to my cas
  Hi,

I had applied for Canadaian Immigration as skilled worker in March, 2008. At that time I had 6 months of total work experience and my points were also less than the minimum required. However my application got accepted and the current status of the same is "In Process".

As per the new rules, I need to have one year of work experience on the date of application. So does this mean my case will get rejected?

Also as per the letter received from the Canadian high commision, I was informed that my case would be processed in 60-65 months. Can I expect an early response now (whether approval or rejection) if new rules apply to my case?

Would appreciate any help on the matter.

february 08 was the change of rule date so it is a little confusing why you would be told 60-65 months for an approval when the new system suggests answers within the year.

If your points are less than the 67 minimum, I would suggest your chances for approval either way are not good.

my name is Mini, I work for an immigration consultancy firm in Vancouver and on a Volunteer basis, I like to help people in immigration matters. I don not charge anything for it.

I read your note and I am surpried on your knowhow of the application procedure. Well, if you apply for the immigration and the file receit is acknoledged, it doe snot been it has been accepted for processing. Your file is accpeted for processing only after you receive your file number. Now receiving file number does not mean your file has been reviewed.

No matter when you applied, you always needed atleast one year of work experience, The only difference is that in the old rules, your job could be any NOC recognized by the CIC, but under the new list you need at least on year of recent experience under the list of 38 occupations.

If you do not have that, your file will be rejected , now ofcourse if you applied after feb 2008. Now I guess since you did not have 67 points when you applied you are going to get a rejection anyways, but since you applied after feb 2008 your file will be assessed under new list and if your job occupation is not under the list, you will be denied.

My advice, withdraw your application, before it gets rejected and complete at least one year of experince and then apply. If you need help, you can email me your detailed updated CV and I can advice you further. Advice is free, if you would like me to make your file, there is a small charge.

Expired Landed Immigrant Status? (in reply to: Confusion whether new or old rules apply to my cas)
I had landed imigrant status form Feb 1994 to Aug 1996. I had to leave Canada, but have been going back to visit family regularly.

Where do i found out, if my landed immigrant status is still valid? If not, what is the next step if i´d like to renew my landed immigrant status?

Thanks for such a detailed explanation.

I will be completing 2 years of work experience by July, 2009 and planning to send the updated documents by that time.

Also my total points would exceed 67 by then.

I am working as Software Consultant in a very reputed IT MNC. My skill(Software Consultant) doesn´t come as such under the recent skill list released by Canadian Government. But I don´t see any harm in trying atleast.

What do you suggest?

I read your reply thought you could help me ,i had applied for the immigration in June 2008 and had qulified with over 67 points however my background is that i am an Electronics and telecom engg. and persuing my masters in statergy from strathclyde university ,glasgow having campus inUAE
(part time)
I am working as a customer care specialist in a reputed telecom company in uae and am also a part ot of customer care training department ,now my issue is that i do not fit into the listed 38 catogories and there is noway i can back out from my dream to settle in canada

My file has been rejected due to the new rule ,please help me with te way to reach to my dream destination.

I have submitted my file for canadian immigration in oct 2006 and NOC was 2281,can u tell me it lies on list of 38 occupations or not

Please could you advice me on the below question:
1- Is it Sure that VISA will be issued after a Clean Medical,or still the application is under paper and background checks...and as long there is NO Passport Request means NO VISA is guarranteed!!!!or it´s only a matter of time...

Raykom, after medicals your file still has to undergo background checks... I tell you so because of my own experience... I had my medicals done in Dec 2007... they expired in 2008... it is now May 2009 and I am still waiting for my passport request ... so the answer to your question is NO... but...

My case seems to be ´uncommon´ and for the most part... I have read that people usually get very excited and even celebrate when they get their medical request because it is assumed that soon after your ´clean´ medical results arrived at CIC you will get your passport request and eventually your shiny golden visa!
