Subject: Ethnicity, please?
  One of the lawyers in Toronto states:

If you were applying for a visitor´s visa to Canada how would you feel if you were faced with a requirement to state whether you are "black" or "white"?

Or, how about, "Jewish" or "Christian"?

Or, perhaps, "gay" or "straight"?

You´d probably be offended by such questions and even be surprised that officials from Canada could ask them.

You´d probably be quite suspicious of CIC´s motives and might even conclude that it´s none of their business.

According to a Canadian Press story published late last week, that´s exactly what happened when the Canadian immigration department refused a visa to the president of an association for survivors of genocide who was slated to speak at Concordia University in Montreal on April 3rd.

He took offence to a requirement that he state his ethnicity in a questionnaire reserved for Rwandan nationals born before 1980 in connection with his application for a Canadian visitor´s visa.

A Rwandan cabinet minister, Joseph Habineza, also refused to declare his ethnicity in such an application describing the question "insulting".

On Friday, a CIC spokesman confirmed that his department is indeed asking this question.
When asked about the constitutional appropriateness of such questions and perhaps other potential questions involving an applicant´s religion, skin colour etc. he replied that "the questions are serious" and that "the questionnaire is under review and ... involves more than just our department". An answer could be expected "by early next week".

If Bill C-50 is passed, Finley will have carte blanche to issue "instructions" to her officers on how to select permanent residents and visitors to Canada. She will not need to consult with anyone nor be subject to any parliamentary oversight.

She has promised that the bill is good for Canada and that, if these powers are given to her, she will abide by the Charter.

Well, equality rights in the Charter are pretty clear. The Charter guarantees that every individual is "equal before and under the law" and should be treated "without discrimination based on race, national or ethnic origin, colour, religion, etc". Given that, how is it possible that even before she is entrusted with these unprecedented powers she is asking constitutionally offensive questions?

NDP Immigration critic Olivia Chow described the government´s request for ethnic classification as "completely bogus" and said that "classifications have no place in the 20th century". She also questioned why we don´t ask such questions of other Africans.
Commenting on this story, Liberal immigration critic Maurizio Bevilacqua described our Charter as the "hallmark of Canadian democracy" which needs to be respected. "Any violation thereof cannot be in any way shape or form supported. The Minister needs to understand that very clearly and we can´t have situations like this arise in the present or in the future."

Chow and Bevilacqua got it right away. Why didn´t Finley or her department?

We should find out before giving her the special powers she is seeking

do you really believe a minority government could get away with what you are suggesting? Maybe for a day - not more.

it is ironic that other countries must declare sect, religion and all manner of segregation information on their passports but to merely ask the question in Canada is scandalous.

Well, i am not suggesting any thing. This is an article by Guidy (a famous lawyer in Toronto). You are right about other countries requiring their citizens to mention sect, religion etc. on their passports but please note that they DO NOT claim as democratic and do not carry the flags of human rights and freedom. So every thing has a price to pay, when you claim that you are a free country and race, religion etc. mean nothing to you then you gotta prove that through actions as well. You can not become lion by simply putting a mask of lion when you are a donkey in real. You know what i am saying!

yes, but I would like to hear more information about what prompted the questions of that conference speaker. What were his affiliations, did he have a criminal record.

There have been lots of guest speakers invited to Canada that end up causing nothing but trouble. I am not suggesting that is the case this time, but I would really like to hear more before I light my hair on fire.

The Conservative Minority government cares little regarding our constitution or laws. The Conservatives offices are being raided by the Royal Canadian Mounted Police over the actions of the Conservative party in their illegal advertisement scam with the last election.

The Conservatives or Red Necks from AB think they can get away with anything because the leader of the Liberals has not found his back bone yet!

Just because you spend the most on advertisement and pay for articles like this one to promote your own business does not make you famous.

Guiddy and Mario I strongly believe pay for the articles they write. Like Ramkissoon does in the Caribbean Cameron.

The word famous I have a problem with because in representative circles it is the big case of the week, month, year etc. that makes you famous. It is how many you win percentage, that counts.

Famous is not how profitable your business is either, famous to representatives is how your equals compare you to the rest of the herd.

He is good, very good and a super good business person and well respected among his equals. You have no idea how envious others are over him grabbing the business space at 74 Victoria Street the location of the IRB and the IAD in GTA - Toronto. Soon after I left CIC Guiddy got office space where Mississauga Hearings and Appeals moved to and now it is Mississauga CIC.

I think Guiddy would not like to be called famous because he always strives to be even better.

I´ll ask him that tomorrow Mike when I have to get a clarification for VENKAT from OZ. I think your comment will make his day.

The conservative offices were raided because someone is suggesting they spent 1 million too much on campaign advertising. I hardly consider that in the same league as spending 10 million of my tax dollars on sponsorships and then denying it until they couldn´t deny it any more.

If they did it... they should get their hands slapped but they have proved nothing at the moment.

Not all conservatives are red necks from Alberta and your comment is offensive. Their arms don´t scrape the ground when they walk and they don´t grunt instead of saying hello.

So a little crook who became leader of a country because they cheated is okay, EVEN if he does not follow the Charter of Rights and Freedoms because he is a good little crook!!!!

There is nothing more holy then the Canadian Charter of Rights and Freedoms. CIC does not even follow there own Immigration act when it comes to processing times see section IRPA 3 (3) (d)

d) ensures that decisions taken under this Act are consistent with the Canadian Charter of Rights and Freedoms, including its principles of equality and freedom from discrimination and of the equality of English and French as the official languages of Canada;

Innocent until proven guilty I agree but which leader was proven guilty?

A politician is innocent until proven guilty and Jean was guilty of paying far too much for a golf ball with his name on it.

Roy, show this to Mamann, as i might need his services in the future so this would help me getting some discount. What do you say. And who knows i might contact you as well because my dad´s case is getting complicated day by day. I am getting different stories from different sources such as online status, call centre and local office. Not sure what is going on?

Roy and Guidy are friends and both are marvelous professionals. Imagine, Guidy does not even know that a stranger is praising his professionalism.

Anyway, yes, you can tell him, i hope he will not sue me for this free advertsiment........LOL

all I am suggesting is waiting until the court does its job.

I am only a conservative when they deserve to be voted for. For most of my adult life I have been a voting Liberal but they lost my vote several times over and I am not left with too many other options.

Perhaps Ontario may wish to take off the blinders and see what the rest of the country sees.
