Subject: Canadian staying in US
  Hi,

My gf is a Canadian. I am in US. If she wants to come live with me in USA and have no jobs, what can she do?

I know that holding Canadian passport can stay in US for 6 months. Can she leave US for a month and come back? Stay another 6 months and then come back. Will she be banned to enter US if doing it too many times?

One option is to get married and apply for spouse sponsorship so she can acquire a green card.

Otherwise, going back and forth as a visitor is usually at the discretion and determination of the border officer, who will usually ask when the last visit occurred.

As a visitor in USA Canadians can´t do any work. just visitor. She can go to school and change her status to F-1 or if can manage a job then go for the usual H-1 sponsorship.

If qualifies, then she can go for NAFTA TN visa to be eligible for work.

Other than those options, like Richard says, you have to be married and apply for her spousal sponsorship which may allow her to work in the US till the case is processed.

US border officers usually are the softest to the Canadians for obvious reasons, if born in Canada. Frequent border crossing is not greatly advisable, but for time being should be OK. Though you have to think of something permanant.

She will not be qualified as an NAFTA since she is only an airline reservation staff, right?

Yes, if I can apply for a permanent status for her, I will gladly do so. But before that happen, it takes some time.

Let me just ask in general (I know everything will be at the discretion of an officer), how long does she have to be out before coming back to US without complication?

I don´t know whether is a time frame for the Canadians to be out of the US for re-enter. If travelling by road; most of the time, they get by the US immigration without having any stamp in their passport or entering the data into their system.

BUT, she they can detect that she has been frequently doign that circle (6 months in US then 1 month 1 Canada) then they would´be sneaky and suspect that she has been working in the US illegally. Naturally they would ask why doen´t your husband sponsor you and straighten up.

NAFTA doesn´t qualify airline reservation staff, right.

I own a home in US close to boarder, am Canadian, but live in Ontario. I am retired and have never worked in the US. I do not rent out my US home, only use it as a cottage. Am I limited to going back and forth across the boarder?

you can be in the US 6 months less a day. If you go to your cottage on Friday evening and return Monday morning - it counts as 4 days... so watch your calendar.
