Subject: CDN citizen and US spouse moving back to Canada
  Your help and any clarification you could bring would be greatly appreciated!!!! I can´t find any clear answers.

I am a Canadian citizen and my husband is an American citizen. I have been residing with him in the US for 5 yrs and we have decided to move back to Canada to be with my family.

As a canadian citizen do I need to move back to Canada before I can apply to sponsor my husband? Are there any particular forms we need to fill out because I am living in the US with my husband and not Canada?? what do I do??!!!???!!?!?!?!

I´ve exhausted my research. I´ve tried to contact the Buffalo CIC but they can´t answer any questions.

How do I sponsor a spouse, common-law or conjugal partner, or dependent child living outside of Canada?
Sponsor Eligibility

You may be eligible to sponsor a spouse or a common-law or conjugal partner or dependent children living outside of Canada if:

* the person you want to sponsor is a member of the family class. If he or she is not, you will be found not to be a sponsor

* you are 18 years of age or older

* you are a Canadian citizen or permanent resident

* you reside in Canada; Canadian citizens not residing in Canada may sponsor their spouse, common-law or conjugal partner and/or dependent children who have no dependent children of their own. They must satisfy immigration officials that they will reside in Canada at the time their sponsored spouse, commonlaw or conjugal partner and/or children become permanent residents of Canada. Canadians travelling abroad as tourists are not considered to be residing outside Canada.

Sponsors must provide evidence that they will reside in Canada at the time their sponsored spouse, common-law or conjugal partner and/or children become permanent residents of Canada. Evidence that they will reside in Canada may include one or more of the following:

-letter from an employer;
-letter of acceptance to a Canadian educational institution;
-proof of having rented/bought a dwelling in Canada;
-reasonable plans for re-establishing in Canada or severing ties to the other country.

* you sign an undertaking promising to provide for the basic requirements of the person being sponsored and, if applicable, his or her dependent children

* you and the person being sponsored sign an agreement that confirms that each of you understands your mutual obligations and responsibilities.

Why take the time to post Google! or Yahoo!

You need to state in the overseas spousal sponsorship when you intend to return to Canada and you must return on the same day or before your family lands.

It is in your forms that you must complete.

Awesome thanks so much for your response. I just recieved my packet in the mail and it is a lot more clear. I get nervous when it comes to filling out the paperwork because I just want to make sure everything is done correct so I start second guess myself.
