Subject: Extreme delay in Spouse case
  Hello Friends,

My wife applied for PR under the Live-in Caregiver in Canada 3 years
ago. I was in Canada at the time but i came to get processed in India.

The problem is that its 3 years now since we have applied and been
separated but CIC is still processing our applications. The file is now
in Vancouver CIC office but even now they are not giving us any
time-frame as to when they will finish processing. We have sent many
letters, also tried our MP but even he is unable to help. CIC just says
they are waiting for background checks. We are going through too much
hardship and pain.

Is there anything we can do?

Should we apply for a Mandamus Order? Cost a lot of money?

Can i get a visitor visa to visit my wife? We are really desparate to see each other. My wife is on single entry work visa, so i dont want her to risk coming to India.

Your advice will be very helpful.

Background checks are not even up to CIC, it is up to the authorities from the contry or countries where the background check is taking place to release the information requested.

I realize that it is a pretty annoying process but until the background check is done the officer cannot make a decision on your application.
If you request you caips notes you will see that there is going to be a note (or code) BCGND pending.

Sorry , but at this particular point in time you might have to wait.

Hi

I have a friend whose background check was delayed but it was for the federal job of canada and not for immigration.
What you can do find out from you police station which department gets this type of enquires and try to get it clear from India. Use whatever means to get it clear Her enquriy went to CBI

Do you think I can get a visitor visa to see my wife? I will come back when i need to stamp my passport. My wife is taking depression medication because of the separation. Its very hard on her.

I would say give a shot for visitor visa.

They may or may not , depends on their mood. If you can afford it why not.

Remember rejection is a negative factor for other county and immigration doesnt work on emotions.

If i were you i would go to delhi and get my background check clear from the top.
If you are a Indian you know how to do it. IF you know the right departmetn where your file is you will find way to resolve it.

Thanks a LOT Riyaz Ji,

I will try to obtain a visitor´s visa.

I will also try to go to CBI in New Delhi. It may be why BC is taking so long. I dont know anybody there but i will try. Thanks.

I also lived in Mexico and USA so it maybe they are the problem. I cant do anything about that.
