Subject: HELP Sponsoring Parent and stuck
  Question boyfriend is sponsoring his currently mom in the US. however his moms visa in the US has expired and one of the the requirements in the checklist for PR is to "include a copy of your visa for the country you currently reside" ((I believe visa for the us was valid when application for sponsorship was put in 2 years ago)

whats should we do ?

is the any way we can get around this ?

should we request for the file to be sent to country of orgin ?

When you say visa expired what type of visa and how long was she admitted for? If she was admitted for one year back then no problem but if she was admitted for less then a year legally big problem. Read regulation 11 which would mean her application has to be submitted in home country.

Do we just send in the copies of the visa even thought they have expired? Your advisa is greatly appreciated

If she (the mother) was legally admitted and resides in the US just submit the expired visa and all pages of her passport. Regardless the Mother is looking at five years processing times at least. This should have been done two years ago when your boyfriend submitted the initial parental sponsorship application.

So you have already been waiting to years and the boyfriend has not even been approved as a sponsor yet. That is why I recommend an H&C application for parental sponsorships in certain situations. Still do not know where the mother is a national.

I should have stated that the mothers nationality is Nigerian and we have been approved for sponsorship (I say we cause we are common law) this approval has taken about 2yrs + we recently recieved the approval letter and application for permanent residency (last week) which we are supposed to mail to my mom in law to fill out then mail to buffalo.

Am not sure I understand when you said that we should have sent the passport pages two years ago. we where informed by immigration just to send the sponsorship application and supporting documents. Was this wrong?

Am am just worried that since her visa has expired we may have a problem.

Do you know how long this process will now take in Buffalo? My mother in law wants to return to Nigeria and we are trying to plan around this or should we just request for her file to me transfered to Nigeria or Accra, Ghana? Do they have a different processing time? If so how long?
