Subject: Valid H1 visa..return US after landing?
  HI
Anyone know for sure that I could return to US with a still valid H1 visa after done with my landing in Canada. I planned to be there for a week. I was told different stories about it and it gets confusing. I really dont want to go through the visa stuff again over the US consulate in Canada for obvious reasons.
I think I am pretty sure that my wife has to go through that cause her H4 visa has expired a week ago.
Your feedback will be appreciated very much.

there would not be a problem to go for a week and come back after landing ..
if u have a valied hi visa and the i94 to return back ...
they might ask for an updated letter from oyur employer .,. that is all

I have valide petition and valid I-94, i.e the visa is not stamped on my passport. How would it work for me please advise since I will be in the same situation as allen soon.

I have a J-1 visa and has the same situation. My visa has expired but I have valid status and I 94 card.

I checked the laws and it says if you go to canada for less than 30 days u can come back just by using the I94 card. No need to renew the visa as long as u have legal status paperwork; in my case DS form valid for travel.

My I 94 is 3 years old. I think it is still valid. I don´t know if I 94 card evere expires. If any one knows more about that, would be appreicated

You have to have Visa stamp on your passport before you enter USA valid petition and I 94 have no meaning when your visa is not stamped on passport .

Well I do have a visa on the passport, but that has expired. Infact the passport also has expired, and I have a new passport. Now, u however can use the I94 card and the valid status to enter US from canada. Don´t have to have a valid visa

I know people who did this, no problem

Please make sure about having valid visa on your passport as rules have changed after 9 11

Its quite simple I think.

If the US H1 visa stamped on your passport has a date greater than the date when you are entering the US from Canada, you have no issues.
If not, then I think you cannot enter no matter what other document you have, like I-94 or company offer letter etc.

I checked with my lawyer, she told me you can visit canada and enter back to US withing 30 days.Stamped visa is not a requirement - valid I-94 is a must though.

Evne though she has assured me; I still will nervous to visit canada for PR card on only valid I-94

Brain you r right about 30 day period buti don´t think it applies after 911, to make sure this rule is still valid ask your lawyer to confirm and has anyone recently travelled without a valid visa stamp (i.e stamp on passport)

I heard about that .... after 911 things have changed ... for our case we came in on B1/B2 and F1 VISA ... got married and now have H1B and H4 VISA ..

From what our lawyer has said ... you have to go back to your home country to have your VISA stamped! That is the new rule after 9/11.

But a friend of mine risked everything by crossing to Mexico for a night .. and then step backed in ... 3 or 4 of his officemates all did that with there lawyer in tow.

The consul did question them about it upon entering... they just said that was the instruction of there company lawyer. The consul stamped there new VISA and they got back in. Lucky!

But this was around 2002 ... when the new laws have not yet been in place.
