Subject: Criminal Charges for Lakehead Spammer
I spoke with the site owner of studentawards.com. He says he´s collected the IPs the Lakehead spammer was posting from and he intends on going to the police and pressing charges. The site is most of his income so it is a big deal for him. Once he knows the kids identity he might also file a civil suit against him for lost income, depending on how long the forums are down.

The forums are going to stay offline until he can figure out how to restrict picture uploads without ruining it for everyone else.

What does the Lakehead spammer have to look forward to this summer?

-weeks or months of uncertainty waiting for criminal charges
-a one or two year long civil trial, costing him thousands in legal fees even if not convicted
-a reprimand from his university if he´s arrested in class/rez
-community service and a fine, minimum, if found guilty
-a criminal record that will cancel out any advantage his degree might have given him over a high school grad
-probably an court order or condition barring him from accessing the internet

Since it was a forum, it is the responsibility of the admins to check that. So I don´t think anyone can do anything against the Lakeheader.

It would be so ridicilous to think that the poluce will even deal with a stupid Lakeheader who ruined a forum!!

Because it is a "forum..." And there are many stupid people over there like the Lakeheader, and because of them many forums every day are ruined.

Nohting happens to these dickheades!!

Yes all that is possible, especially the civil litigation if the owner suffers loss of income. I doubt criminal charges will ever be laid since the spammer is probably still a minor. The law is far too lax on minors and they know it.

A few years ago a friend of mine was charged with mischief for doing something like this but it was an IRC server he took down. He was arrested months later when the police showed up one evening at 10pm, took all the electronics from his house, and gave him dates to get fingerprinted and appear before a JP. The JP gave him bail terms wouldn´t let him use the net unsupervised. The charges were dropped for some reason but only after he agreed with the judge not to reclaim all the seized computer equipment. His family lost several computers over it.

this reminds me of something that happened many years ago at my high school. Someone set up an internet site and started dissing all the teachers and put up their addresses and phone numbers. the RCMP came and took his computer, he got expelled and lord knows what else happened, probably got charged. anyways, shows that you can´t just screw around on the net.

BTW - regarding the comments about it being a public forum, remember that forums have terms and conditions. You had to agree to them to sign up at studentawards. And spamming message boards with pornographic images that eat up space, bandwidth, and don´t allow other users to post is a denial of service attack.

Stuff like this happens all the time, true, but there´s differences in this case. The website and spammer are both Canadian, making it very easy to pursue charges. The site owner apparently relies on the website as a source of income and had clear T&C´s prohibiting the spammer´s conduct - now he has to take down the site and fix it at his own expense. And the spammer has proven himself to be without any redeeming qualities at all... it´s not a one-time thing, he´s been harassing these forums for weeks, during the time of year students need admission advice most.

Lakeheader, try all you want to convince yourself otherwise but you blatantly broke the law and hurt some dude´s business. Unless you used anonymizer proxies outside Canada, your identity is a subpoena away. Consider yourself lucky if there´s no civil suit. A mischief charge isn´t the end of the world but spending so much time and money in court during your university years will suck.

But the dickead will be OK. Police will just laugh at the situation, if studentawards ever go there.

Oh yeah, I agree... Also, it is the administrators´ job to clean up the site. Otherwise, that is a forum, and dickheads like that always exist, and always existed.

He has already offended the law as he posted nude pics on that website too. The target viewers of that forum is under 18.

I guess the original thread starter is a studentaward staff too.
