Subject: Applying Canadian Immigration for my wife (H4)
  Hi,

I am here on H1 and and my wife is here with me on H4. We came here 9 months back and we are planning for Canada Immigration, (as her brother has als moved to Canada)

Now my questions to the gurus of the forum are:

1) Since she is on H4, can she apply for the Canadian application. What all documents she has to give in the support of that.

2) We have somehow arranged the PCC from India for both of us. Is it a better option to have one from here from Indian Embassy also.

3) Do we have to give the Medical Test Reports also along with the application,(I know we can send it later, but we want to give all the documents in one shot) So if yes can she get the Medical reports from India and submit here.

4) Since she is on H4 she cant open a bank account here so can we show the Indian Bank Account statement.

5) Is it possible that at present I do not apply for the immigration and then when she gets her application approved I will appply myself as a dependent (my brother in law did the same for his family, as it involves a financial risk )

I know I have asked a lot of questions but then it will be great if you people can help me.

First thing you should do is find out if your wife qualifies as a Skilled worker. She MUST have at least one year of full-time work experience to be eligible to apply. Please visit the following link and take the test to find out if she qualifies under the current point system.

1) If she does qualify please visit the following link and download the "Federal Skilled Workers" Guide to get detailed information about the process of applying and the requirements.

She can submit the application as a Skilled worker from Buffalo, USA if she has been admitted into the US for a period of more than 1 year.

2) PCC from India is fine.

3) If you are applying as a Skilled worker then you can not get the medical done until you get the medical forms from the Canadian embassy.

4) You can show the money in your bank account in US.

5) If she applied for immigration your information HAS to be provided on the forms. Even if you are a non-accompanying spouse you will have to undergo background and security check and will have to get the medical done.

Oh thanks for the info.

She has a good work experience of around 5 years but she has that experience in University Teaching.

Do we have to select the job for which we are filing the application and is there anyway we can find that which job has better opportunity.

And for her application what shd be the prrof that she has been year for last 1 year. What proof shd I submit to support her stay.

And my bank account will be enough for the funds approval.
Wont she be needing a bank account on her name as she is the main applicant.

Hi Aa,

Follow Kenny´s advise, take the self-assessment test to see who´s gonna score better..the passing point is 67.

Yes you will need to choose the job if you will apply as Skilled Worker...here´s the NOC listing link

About the bank account....I am on H1B here but I was able to add my wife´s name(H4)on my account as account holder too. Ask your banker about this.

I also believe that CIC will honor all your funds regardless of the location (India, US etc) you just need to present a conversion in Canadian Dollar of your total funds.

You wife´s NOA (Notice of Action) and I-94 should be enough proof that she´s staying here in the US legally and how long.
