FBI/ Police Clearance

Subject: FBI/ Police Clearance
  hey everyone-

I have already sent in my application with all necessary documents (spousal sponsorship- inland). They have the application, fees receipts, medicals and FBI clearance.

Now according to CIC, for the united states everything I read points to the FBI clearance, and any country you have lived in since you´re 18th birthday. BUT I have heard that for the States you need a police report from different states.... I lived in two states, but called my main one, and they told me if the FBI didn´t have anything, it was pointless to get more. SO, my question is,

Do I really need to get Individual STATE police clearances if I got my FBI and it came back No Record?

Yes I believe it is necessary to get individual state clearances. I know that CIC does specifically ask for them in the guidebook. I also am being sponsored by my husband and I had to get a state clearance as well as an FBI clearance. I would suggest calling CIC for sure. Its better to be safe than sorry. Its best to avoid any delays if possibly. Good luck to you.

I haven´t heard of this, needing reports from each individual state. Where did you hear about this?

Oh I just saw Supergirlie1´s response. Does this apply to all applicants? I´m not sure where to look for this information; do you mind telling me what the "guidebook" is? thanks!

no, you do not need police clearances from each state -- only from the FBI. the CIC instructions clearly state they require the clearances from national authorities. states (in the US at least) are not national authorities.

"A Police Certificate is required from the country where the applicant CURRENTLY lives, along with ALL other countries where the applicant has resided in for 6 months or more since age 18."
"The Police Certificate should be issued by a NATIONAL or FEDERAL police agency where possible. Applicants may need to apply at an Embassy/High Commission if they are not currently residing in that country."

I´m sorry grendel, but you´re incorrect.

It specifically states in the Region Specific forms for the United States (of the applicant´s forms -IMM3910) Appendix B - Police Certificates/Clearances:
"USA - If you have lived in the United States, you must provide a State certificate in addition to National FBI Certificate"

Their reasoning for this is that some charges would not show up on a federal level, though they might still be deemed a criminal offense for the purpose of the application.

hmm, interesting ... your link is to instructions for family class applicants I applied as a skilled worker, and the skilled worker application instructions do not have that language.

also, I´ve lived in the US and France. I sent only the French certificate one from the FBI. CIC has never asked me for anything else. I received my IA 6 months ago, and it was asked for.

It´s odd they have different requirements for family class and skilled workers. But then, why should we expect anything more than ambiguity and confusion from CIC?

Yep they are very good at confusing everyone. I think they like us calling them with questions. I do find it funny how everything is different when you apply under a different class. You would think that the certificate requests would be the same no matter what, but as it seems you do need state and federal certificates when applying under the family class in Canada.

my application guide doesn´t have the region specific stuff tho. under security clearance it lists FBI for United states and that´s it...

I don´t know, I´ve been looking at the inland application forms and it´s also ambiguous;

"Certificates/Clearances are normally issued by police authorities, but in some countries you will have to municipal, provincial, federal, or other government authorities. You may be asked to pay a fee for the service..."

This was one of our questions when we were considering an inland application, but according to our Consultant the rules are the same for both inland and out-of. For the US, state clearance was required in addition to FBI.
