Subject: US visa renew at time of the PR Canada landing
  OK what is the deal on renewing your US student visa in Canada if it is expired and you need to go to Canada to land for your PR?

My US visa expires soon and I never anticipated this much delay. I was expecting to get my PP request in May 2005 latest, by all account as my medicals were done in Oct 2004 and all docs submitted by Dec 2004.

Never anticipated the BG checks to go thus far.. which I´m sure will go a year (I see for most people it has been a year). So my first best shot will be in Jan 2006 if it happens. But by then my US visa will expire - not the I-20.

Can I re-enter the US on expired visa, but a valid I-20 from Canada? I had heard that for upto 30 days it is allowed? How far is that true?

If you are still enrolled and in status then you can come back within 30 days of time. This is what i heard as well. why dont you call Home Land Security and find out if what is rule on travelling to canada on expired visa. What i know for sure is : one cant trvel on OPT even with valid visa.

There is one more thing you can do if you did not complete your studies yet, you can land in canada and for re-entry to comeplete your education, apply for a VISA at US consulate in canada. I am sure you will get the visa.

The best idea would be to renew your study permit. Just to be on the safe side. Probably you´ll get your PR as soon as you´ll do it, :)) (that kind of things happens very often).
Strangely, I thought before that applications from America are processing faster than for in-Canada applicats.

Thanks for the advice and the wish hell,

I have what is called as a D/S stamp (i.e. I can stay till duration of my course). However the problem is the visa, if it expires I cannot travel out. Really speaking I´d want to travel out to go meet my family etc.

But I´d definately look into a renew. And as you mention, I may just be lucky to be called for Canada PR!!

Well I´ll keep my fingers crossed..

I have hear of being able to travel to Canada on a US visa and being able to re-enter as well.

I am in a similar situation where my wife is going to school in the US at the moment on a J-1 visa. She must land in Canada before Oct 19 but her school in US goes until end of Nov.
Are you saying she will be able to cross to Canada AND re-enter the US with her US visa?
BTW her US visa states there are no re-entries. But I have heard that travel to Canada and re-entry is allow. Can anyone confirm this? Please provide a link if possible

Rules are confusing right now.

However, you can travel to Mexico and Canada for a period not to exceed 30 days on your valid I-20.

As some sites say consulates granting visa is only a YES to travel to the US. It no longer applies when you have landed US, then it is the Immigrations. It is upto them how they handle the case. I have asked this question to some officers and they mention that if I have valid I-20 and I-94 with D/S stamped and travel to Canada it is OK. But I´d rather have a VISA for peace of my mind.

Sometimes I have seen officers look only at my VISA and sometimes they only look at the I-20 when I travel. On my recent visit to Canada, the officer at the US airport only looked at my I-20 and I-94, never even looked at the VISA. He just asked why I had gone and for how long. And then stamped my passport and I was in.

When you cross to Canada do they take the I-94 everytime? Or are there cases where you travel to Canada for a short period with plans to return to US where they don´t take it? I would think that if they dont take the I-94 you should be alright to return to the US no problems...even if you have a single entry visa.

Yeah the rules are confusing and it is hard to get accurate information on this. Potentially a few thousand dollars and a massive amount of flight time are at stake here if we can figure this out in time. If she can cross, complete CDN landing procedures and re-enter the US, we´re golden.
