I-94 :leaving US and entering Canada

Subject: I-94 :leaving US and entering Canada
  In relation to a question few postings below, when somebody is leaving US by land, and comes to the border with canadian visa but expired us visa (I-94), do canadian officials ask for I-94 and do they surrender it to us officials or do they care at all? In other words, will that person be able to leave US without them knowing that he/she has overstayed?

They don´t care about your I-94. Some crossing points (not sure if all, just the ones I saw for example in Montana), you don´t even go through the US thing, just straight to Canadian. The same when you come back, you don´t go through the Canadian point, but pass them and go to the US customs. I actually almost left the US this way because I didn´t know I was in the neutral strip. Just peacefully did my u-turn and ... boom...the US customs stopped me. Luckily I had all my passport and all with me :-)

Canadian officials has nothing to do with I-94. Moreover I-94 is landing record for United States, how they could ask for I-94? So just do not worry about it.

I know that, but the guy above even said that on I-94 it says that when leaving US (and it is a record of entering/leaving US, not just entering), it states that the person should give it to canadian officials. I was searching on the net, and I found information that even if you are crossing by land, you should surrender I-94 to canadians (or mexicans), but from then on I am confused what they would do with it if they have nothing to do with US immigration??!

What you talking about, surrender I-94 to canadian officials?. Certainly, I knew that I-94 is Arrival-Departure Record, when you left country No one ask for your I-94, as long you leaving country. Nowadays, they have other issues specialy on main USA airports, however, those issuse has nothing to do with I-94.

Sorry Rana, I was just quoting someone else´s reply since I was confused too(here it is):
"I drove to Ottawa via the NY 1000 Islands border crossing. You cannot stop at the US border post while departing the US, you will be stopped only on the canadian side.. The road is such that you enter the canadian border post while entering canada and the US post when entering US. Since you are leaving, the US dosent care.. Moreover the I -94 card on the back clearly says that submit this card to canadian officials..."

Leaving to Canada with expired i94 (in reply to: I-94 :leaving US and entering Canada)
i had h2b (seasonal work visa), now my h2b has been expired also i94. its been 6 months. before h2b expires, i applied for h1b, got denied and appealed. right now all i have in hand is i797c with case type i290b which is pending received case of my appeal. on my appeal i797c, thers nothing mentioned that i can stay or i have to leave.

i know i am not legally authorized to work, since i have SSN i found a restaurant job and working full time which is totally illegal. if i get caught i´ll be kicked out from this country. seems like nobody knows yet what i am doing.

my lawyer said if my case is pending i can say but can not work. now my questions are:

1. if i want to leave this country what might happen at the airport since i have 7 8 months expired i94?

2. is there any fine or restriction seal for me for expired i94?

3. can i show my pending case which is i797c to avoid any sorts of legal actions since my attorny said i can stay with pending case?

4. if i get the canada visa and try to go canada with expired i94, is there any problem?


please help me with the best suggestions
