Subject: Background check - pls help!
  Hi all.
I have a small question. When one completes schedule 1 form - there is a question have you ever been refused a refugee status in Canada or any other country. I have actually aplied for asylum in the UK in the past, but I´ve left the UK out of my own will and was never refused refugee status or deported. Moreover, I hold a degree from a British university, and I have to tell about it to the CIC. The question is:
1. Would CIC try to investigate how legal was my stay in the UK - student permit, etc.. And if it would found I claimed asylum in the past - would it affect my application? Could CIC receive info from the Home office? As far as I know the check is only for the criminal past...
2. If I answer that I never WAS REFUSED a refugee status - will I be lying? Because actually, I never was:))

Please, answer!!

CIC will certainly want to know that your stay in the UK was legal, and by what means. It is safe to assume that they find everything out about you; background checks are not merely criminal checks. Since you did apply for assylum, yet were not actually refused, I think you could answer that question truthfully by stating "NO". HOWEVER, I would write a detailed explanation about your situation; that way everything is clear when they find out that you had indeed applied.

As you were not refused say so on your application. But the fact that you applied for asylum is bound to come up during the background and security checks.

So I suggest that you write a seperate letter and mention this fact. Give details about your application and why you left UK.

Please do not hide anything from the immigration officials as it will just create a problem for you in the future.

well.. But as far as I know my application for asylum was confedential and Home Office has no right to make it public. Moreover, as far as I know I sign the Schedi\ule 1 thing to allow Canadian authorities to querry only info about me connected to crime, convictions etc.
Well... Does anyone know if the fact that I was claiming asylum in the past is gonna decrease my chances for a skilled worker track?
And, assuming they get to know I claimed the asylum - these were still LEGAL grounds for me to live in the UK.
Suppose I had a student visa - do I have to declare that I was a student? No. Only if they would ask me. Same here. Because If I submit it on the paper I may be afraid the authorities of my native country will know that, but if I tell it during the interview I can be sure none will no it except the Canadian immigration.
What do you think?

Forgive me if I´m wrong, but it sounds like you want us to agree with you and say, "yeah, don´t worry about it.". BUT, like Kenny said, and MANY MANY people on this board can attest to, hiding anything from the officials at CIC will only create problems. What´s the problem is writing an explanation? Rule number one for application into Canada: BE HONEST, ALWAYS. You are asking a country to take you in; don´t give them a reason to question your intregrity. You´ve said you were in the UK legally, so you have nothing to worry about there. Write your explanation on a separate sheet of paper, attach it to your Schedule 1, and apply with a clear conscience. There is little or no chance that your previous application for assylum would decrease your PR chances now, especially since you were legal and assuming you are honest about it to the Canadian authorities. Maybe people out there will disagree with me there, but I think it´s common sense. Good luck.

Well.. I agree as well. It should not affect my application. But what if authorities in my country will get thisinfo from the Canadians???

Background checks are carried out by both RCMP and CSIS (Canadian Intelligence Services)...so you can just imagine how much info they can get....

The minute your passport goes into the system, them will know about your UK refugee claim. So, you have a choice... tell the truth so they do not catch you lying... or do not apply at all so you do not take additional risk of your home country ever finding out that you ever applied for asylum.

How is anyone sure of what really happens?

No one on this forum really knows what really happens in background check and what is the information they really check.

This does not show that I´m defending the person to state false information. No, by default it is always right to state the correct information and defend any questions by CIC.

However, I´m only pointing that without knowing what BG check is, how can you all give this person any advise on the fact he is asking!!

May be many of you are unaware, but as a person who claimed asylum I would like very much that none will know about that. This is my personal issue. UK Government says this info is strictly confedential, if it passes this info to anyone I may legally sue the UK Government for that, and they will pay me a lot of money as compensation.
