Subject: HELP - what happens to my immigration status
  My story is very different, i got married to this person who is canadian citizen and from the beginning we had problems. He did not sponsor me for some time and then later he sponsored me but is not asking me to come join him. So when it was only 10 days before the expiry of the visa, i came here without his permission since i already have the visa.
Now after coming here i found out that there is another women and he sent me seperation papers back dated to last august so he can apply for divorce in august. Well this is not true that i wanted to seperate and has no intention of separation.
What can i do about the situation, itseems i have no say in what he does since i have no proofs to show that we stayed together last december when he came to visit me back home.

Will i loose my immigration? Are there any lawyers who can give free consultation for me? I am so lost as i do not have family, money here and i do not want to go back letting him take me granted for whatever is happening.

Sorry to hear about your story. You did the right thing by coming to Canada. Now that you have landed in Canada as a PR you do not need to worry about anything. You are a PR of Canada now and no one can take that away from you now. You do not have to show proof of marriage as the biggest proof is that he sponsored you and you immigrated to Canada as his spouse.

Your husband has signed an agreement with the Government of Canada to support you financially for a period of 3 years from the day you land in Canada as PR. He is required by law to support you financially. Even if he divorces you he will still have to take care of you (financially) till the three years have been completed.

If you are not getting any support from him you should contact the relevant govt authorities and ask for assistance.

Kenny is absolutely correct on every point. If your husband tries to suggest at any time that he has any control over your PR status, he is wrong. You have nothing to worry about and don?t need his permission to land. Welcome to Canada, where you enjoy full protection from the law and enjoy as much right to be there as anyone else as long as you don?t commit any crimes and were truthful in your original application.

As Kenny stated, your husband is financially responsible for you for the next three years regardless of any change in marital status. If you collect welfare of any kind within this time, he must pay it back. Do not use this as a way of getting back at him. Do not abuse the system. But if you find yourself unsupported and without money before you get a social insurance number so that you can work, then DO collect welfare so that you are not left on the street. It will be your husband?s own fault for abandoning you, and the fact he has to pay it back will be his own problem, not yours.

Once you receive your PR card you may leave Canada for a maximum of three years out of every five-year period without losing PR status. If you stay in Canada for three years out of a four-year period, then you may apply for Immigration status.

While your relationship sounds like it is over, your new life in Canada has just begun. I?m so sorry to hear of your broken marriage, but I?m very pleased to welcome you with open arms to my country.

Its a serious affair here... a good start in a bad way... seek some legal assistance if you choose to stay in Canada...

depressed dont be depressed anymore since you a r PR holder you can sponsor me and i will come and stay with you. lot of fun we will have together and i will keep you happy emotionally, physically and sexually(thats more important)

Canada is a great country... people get divorced all the time, get cheated all the time, and the like, but you are in control of your destiny. Learn to love the country, and don´t let anything hold you back.

Try not to force him to support you. Try as hard as you can to do it for yourself. He is not responsible to support your every finacial need, only your necessities. Relying on money from him will not leave you with very much... just the bare minimum.

But, if you need social assistance to keep you off the street, you can get this, and he will be forced to pay it back to the government. But, living on social assistance is not what it means to be Canadian. Having a social net to prevent you from starving, is being Canadian.

Forget him, and start your life starting from today.

Work on getting your SIN card, your health card, your drivers license, social assistance if you need it, and getting a job.
