Subject: Sharon - Question for you
  Hi there,

I just noticed this from your post to marielovesashley:

"immigration as a matter of principle does not allow spouses to visit each other for fear they will remain in the country illegally."

This is a bit concerning to me, as my (now) husband (American) was recently refused under conjugal class (for no other reason than we, at the time, could not prove an impediment to marriage) We´ve since got married and are about to re-apply as spousal, but will he have trouble visiting me in Canada now that we´re married? He has no criminal record or anything, and he flies into Toronto every 4-6 weeks and has for the past 2 years without any trouble at all... and he´s due to come back on Thursday for the closing of our house we just bought. Do you think they´ll hassle him at the airport now?

We have a letter from our immigration consultant in the event he does get pulled in, explaining our situation and his intentions.

Thanks for any help you can give...

who knows... that is the problem. if your partner has a good track record of coming and going, they are more likely to give him the go-ahead. It is good you have legal reasons for him to enter and you have additional documentation ready.

But, when you have made no applications, and just think you are going to move freely back and forth... you are simply asking for problems.

Thanks for the reply.

Being American (non-visitor visa country), does he need to make applications to visit now, as opposed to before? Does being refused PR take away his right to visit?

This stuff is so confusing. Our agency told us not to worry, but you hear about horror stories of people being turned back.

He will have his return flight info, too. Hopefully, with the letter from our agency, that will suffice.

They can and do stop people, but there is usaully some sort of reason (like the person is coming up with a car full of furniture and stuff).

He should have proof of ties to the US in case he gets a CIC officer who wants to save the world.

Proof that he works in the US, pays rent or a mortgage, return ticket... stuff like that. If they get the indication that he is "moving in" with you, then you may be out of luck. Or if they find out he stayed for 6 months or something, then it may set off alarm bells.

I know people who were not so lucky the other way around. They were applying for their greed card in the US through marriage to an American, and were told if they left the US while the case was pending, they would not be allowed back in until the case was resolved.

Thanks Dave and Sharon. I´m probably worrying for nothing.

He´s back and forth every 4-6 weeks and has been for 2 years now. He stays anywhere from 4 to 10 days at a time. They never bat an eye at him, and he´s never been sent over to the immigration office at the airport.

He´ll also have his notebook computer with his work meeting schedule for the next 2+ months. He should be fine.

We´ll find out in 2 days, LOL.

Overall its funny with US and Canada...

If the spouse gets married and wants to come to Canada or US then thye have to wait for months and months to join their spouse...

But a spouse of a foreign worker wants to go to US / Canada then they can get a visa in 1 day...

Isnt that a big irony of our system...
