Subject: Parental sponsorship applications - lawsuit
  It is apparent today that the processing times for parental sponsorship applications will exceed seven years. At some processing posts, applications will require a minimum of 10 years or more.

Sponsor Your Parents is considering a legal action against CIC on this matter.

The mandate of the lawsuit is to create the political conditions required to cause a change in the processing periods and/or to obtain damages. The purpose is to pursue individual applications to seek individual remedies in their specific cases. It is possible that later on or in parallel, a class action will be commenced.

In case of successful judgment or settlement, those individuals who obtained mandamus first, prior to the commencement of the class action, could benefit as their cases will be processed first, by order of the court. That´s what happened in the first Dragan case where mandamus went to over 100 people, and no one else.

The more plaintiffs involved the more chances such a lawsuit can meet its goals as the CIC realizes the extent of the problem. The approximate cost is few hundred dollars per individual application and will most probably be proportional to the number of participants, the more participants the lower cost is expected.
