Subject: married canadian no visitors record
  Hi everyone,
I was married in Canada to a canadian citizen in 2000.
I have been living here illegally since then. My wife works full time and I take care of our son here in canada since he was 6 years old. I now have a job offer. It is time to take the plunge and become legal.I have a DUI conviction over 8 years ago and another one 14 years ago.Police cert. and fbi clearances are clean with no record found. But I am sure they will turn up through DMV in California.I would like to get a visitors record started. Should I leave and re enter or send off forms ( spousal sponsorship) to Vegerville Alberta. What are my chances??

If they find out about the DUI, they will have to be pardoned. Living illegally in Canada won´t look good either.

The DUI thing seems harsh to some, but not harsh enough to others. I have seen Canadians at the airport in Toronto, going to the US for vacation, and being turned around and sent home because of a DUI in Canada.

Since these are old convictions, you may not be banned from Canada, but you will need to get these pardonned. I am not sure how to do this.

Just trust me and no matter what you do, be honest. Mistakes happen, whatever - but if you are dishonest and are found out, trust me it will be ten times worse than just dealing with the consequences you may have to face.

I think it would be better for you to apply IN Canada class also. Under the new rules, you can still technically stay here "illegally".

Regarding getting a visitor´s record started...again - no point doing this.

You have to list all of your addresses and what you´ve been doing for the last 5 years. They can and will check. How do they do their checks? Asking neighbours, or places you say you´ve worked? Again - be honest and just tell them what you have been doing.

Regarding the DUIs - because your FBI clearance and security clearance (from here also) show nothing, I think you´ll be fine. I´ve never heard of them doing a DMV check anywhere.

You should apply as a sponsored family member in Canada.
Under the new regulations you may apply from within Canada even if you are an illegal alien.

With your convictions you might have a hard time and for sure you are going to be call for an interview with an Immigration officer.

The other thing is that Vegerville Alberta Processing centre doesn?t process application for sponsorship or Permanent residence.

You have to mail your application along with the sponsorship application to Ontario.

Applying for sponsorship is done first, then PR after they reviewed and accepted the sponsorship???/
This question is for Andy or anyone who might know.
Also what about Criminal Rehab form, probably wait for CIC determination???

Medical and RCMP clearance (in reply to: married canadian no visitors record)
Can I get or should I get the medical done here in Canada before submitting paperwork and RCMP clearance has not been done either. I thought RCMP needs a file number (immigration) before they do a fingerprint check. Thanks for any info, people with knowledge.

Just becaue your FBI check shows no record, does not mean you are free and clear with the DUIs. Canada and the US share criminal information with each other like no two countries in the world.

A DUI is not a traffic infraction in Canada, and just because it may be treated differently in the US, does not mean Canada will consider it not to be a crime.

Just be prepared for CIC to discover that you have two DUIs. A DUI is a CRIME in Canada... its not like speeding or parking in front of a fire hydrant. It is more like assult or theft. It is probably Canada´s single most serious criminal problem. Like, many good citizens will not one day decide to physically assult someone at random, but they see no problem driving drunk. Canada is coming down hard on this offence, and they will not take it lightly that you have been caught doing this twice.

I am not judging you, but just want you to be PREPARED... the CIC will likely find this record (The INS finds Canadian DUI offenders in the line at the Toronto airport... they type in your passport number, and boom, DUI comes up on the sceen)

Hi Rachael,

My husband got a OWI 4 years ago. Never even had his license revoked. Has been back and forth to Canada 3 times since then but last year they made him go back. He´s thinking of applying for a temp permit but it costs $170.00 with no guarantees. Also, if he plans on going he needs to buy licenses to hunt in Canada, another $200 ea, (nonrefundable) if he is turned back again. Are his chances good they will give him a temp permit? His points on his MI DL will be gone in Aug. How long does Canada keep records on old DUIs?
