Subject: ADR appeal allowed, received request for info, Q!?
  Hello,
I am a Canadian citizen sponsoring my wife (from US). We initially applied for her in March 2004, and received notice she was denied in Dec. 04 .. for whatever reason. However we were married during the application process, and after appealing our decision in January 2005, we had an ADR conference take place in March 2005, which was allowed because the ruling was wrong in fact of law. In May 2005 we received a request for info (the marriage license) which was sent in the same day via fax .. can anyone give us some info on when we can expect this thing to come now? I am at the point where I´m ready to call the immigration minister´s office and tear a strip off someone. Thanks!

Hi Steve,

I´m very sorry about your frustration. That´s how Canadian Immigration works. Your tax dollar at work :(

More than once, I had clients who tried to bring their wife to Canada and took 7 years going through applications and appeals (which I did the appeals).

It is normal that they made a mistake and delay a file for 2-3 years. News: It is getting worse.

That´s why everyone in the profession is crying foul.

Consider yourself one of the lucky one that they settled at ADR.....a lot of people had to wait for the Hearing (7 months later) and then the processing (another 6-7 months sometimes) or if not federal court (another 1 year).

HI Steve...You say you appealed your case in January of 2005 to the IAD,,and that you had your ADR in March??..That is only a few months...Can i ask what province you are from??..I can not believe that your case went threw so fast in the appeal process...I had thought it takes 4 months just to receive the record of appeal from the CIC..I am also going threw a appeal,,so your story is of interest to me..Did you have a lawyer working for you??..And if so,,how did you manage to get your ARD so fast...Thanks so much for any information you can provide me,,Have a nice day there..Sandy

Hello,
Thanks for the replies everyone. I am in BC, and we went to the ADR conference without a lawyer, because we knew we were right, basically. The officer from Buffalo didn´t believe we had met the requirements of a conjugal couple (even though they knew we were engaged, and planned to be married DURING the process), so we decided to represent ourselves. I appealed the decision in January in Vancouver, and received a conference date of March 9, where the decision was allowed. Waste of my hard-earned money if you ask me .. not exactly a threat to national security (a 25 year old woman leaving her family to be with her husband in a foreign country?) Hope that helps, if you have any more questions ask away and I´ll try to answer as best I can.

HI Steve...How and what informaion did you send to the Immigration Appeals Division in January..I mean it only took you 3 months to get a ADR meeting with the IAD..How soon after you sent in your notice of appeal to he IAD , that you got the date for your ADR meeting??..I mean was it only a few weeks after you sent in your appeal papers that they gave you a date for the ADR??..Did you recieve your record of appeal in this short time of 3 months??..Did you send in any other information to the IAD to prove your case??...Wow you are so lucky it has went so fast for you there in B.C..Also lucky that you did not need a lawyer,,really the extra cost of getting a lawyer,,and all the extra time trying to prove tha one´s relationship is true and real is so tiring at times..How can this kind of thing be going on in this CIC...Do they real have any idea what they are doing to thier people of Canada,,and do they really care...Thanks for any info you provide me with..Have a nice day there..Sandy
