Temporary worker visa, maybe?

Subject: Temporary worker visa, maybe?
  Ours is an odd situation (I think) but a legitimate one......

I own a small growing import/distribution company in Quebec/Canada. My sales manager in currently living in Japan (she is an HK Citizen) and we have been in love for the past 2 years now. We´ve decided that we want to be together here in Canada permanently. I am a Canadian born citizen. Her current employer (my supplier) has agreed to assist us in her transfer to Canada, where her skills and technical knowledge will certainly help the business in Canada grow. The supplier has written a wonderful letter and passed it along for inclusion in our application She will have a good salary listed on the application, and the professional requirement are quite real & worthy, but the personal issue causes us to want this more than the professional reasons.

We´ve recently hired a consultant to assist us in the process, he suggests that we have an excellent chance of having a temporary foreign worker visa approved, but as a result of this whole situation having a personal as well as professional consideration involved we are probably a little more anxious about it than we would be if it was simply professional.

My questions to this forum are as follows (hope you can answer some of them);

1) How easy are temporary working visa obtained?
2) How long does this process usually take?
3) Our Lawyer/consultant has suggested that we request a 2 year visa, is this likely to be graned for this time frame, or typically less?
4) Lawyer/Consultant has advised us that if she remains in Canada for a period of two years then she can apply for a different resident status on a more permanent basis. Can some one provide more information on this route?
5)IF the TEMP worker visa is rejected, what are our other best routes, and how long may the other routes take? Should we consider her coming to Canada and simply staying for a 2 year period? What are the upsides and downsides?
6) She has in the past (almost 13 years ago, been issued with her family a SIN and landed immigrant documents in Canada when her family TRIED living in Canada, but then returned to HK, do these papers(status) help our case at all in any way?
7) Will becoming married while she is here on a temporary worker visa assist us in not having to have her move away from Canada in the future

So sorry for this long post.... I can see after reviewing this forum that all are looking for some comfort/encouragement for thier own situations.... We are now just starting to look for the same thing.

Working Visa is issued if the HRDC find enough proof that there is no Canadian resident or citizen who can do the job what the foreign worker is suppose to do. OR in other case. If the foreign company wants to open a new branch in Canada and is sending someone who will employ Canadians.

Depends... but I am not sure about it.

Once the person is here in Canada on a working visa or so then it makes it very easy for applying of Permenant residency. You dont even have to go thru a lawyer for that. You can just fill the skilled worker application and while you wait and work in Canada the application will go thru in about 14-18 months and the foreign worker can get immigration. The time may be less that that but not more then 18 months as we see now.

If the Temp worker visa is rejected then you guys can get married and sponsor your spouse and get her here. That will take short time and your wife will be here. Once she is here she can go back to the same work and continue it here.

Second thing is that she can ask for a visitor visa come here and once she is here you guys get married and you sponsor her from within Canada. With this she can be with you continue with her work silently, thats also a better deal.

It will be a plus point but you cannot depend on it. Its good she has been to Canada before.

Yes, its good... if she is here and you guys get married its fine. She wont be removed from Canada.

Maybe a few follow up questions.....

Does anyone know if the time line for this type of (Worker Visa)application is weeks, months, or years?

Still looking for a reply from you kind sould on how long a worker visa might be granted for?

In the reply above it was stated that the time to process a resident application was appx 14-18 months. Can this process be started ONLY after the 24 month period required to qualify has passed, or can an application be submitted while she is here on her worker visa?

Since she is HK Citizen she does not require a visitor visa to travel to Canada (Or so I understand). If we were to marry while she is here visiting, can I apply for spousal sponsership while she remains in country?

What is the typical time for a spousal application to be approved?

She has a Masters in Languages, Im wondering if she were to apply and be accepted by a Canadian University to continue her studies how long this might take?

I would say just get married and teach her a lot of French (I am talkin bout liguo, not kisses) and let her apply for Quebec residency! I think that one goes thru the system much fast.

Thanks for the advice......and the grin. She already is talking french classes in Japan. But the lawyer has advised this is not as necessary for a temporary worker application. Is this true??

Also, are you suggesting that having her immigrate as a spouse to Quebec would be faster than haing a foreign worker visa approved? What are the average timelines for both types of request?
