Subject: Please help !!!: landing was denied
  Please help!!! we feel so sad and desperate about our landing experience.
Our PR was approved in April this year from Buffalo office. My husband tried to land in Vancouver by himself today, but got denied because we didn´t apply for PR for our 1-year old baby. Our baby was born in USA, and we plan to apply PR for him after we settle down in Canada. My husband got denied because we didn´t inform them we have a baby and didn´t apply PR for him. My husband told the officer that we will apply PR for him, but officer said if we don´t apply PR for him now, you can´t apply in the future. And he told my husband that we need to do medical exams again including our baby.

My questions are:

(1)Are we going to start our application process again? Or we just need submit our medical exams and wait for result?
(2)If we don´t need start the whole process from the beginning, how long will it take to get our new landing paper?
(3)In this situation, what are the bset things we should do right now? Do we need contact buffalo visa office right away, and tell them that we are going to apply PR for our baby?

Your help will be highly appreciated!

The visas are invalid now.
It seems that you didn´t advise Buffalo of a change of family composition (as was instructed to do on the AOR).
So, unfortunately, you have to start from scratch.
You could try to contact Buffalo (good luck getting through) but since your baby is 1 year old, they may say that you had one whole year to notify them of the birth and you failed to do so.
I´m sorry to have to give you the bad news.
Anybody else want to add?

Thanks for your responding.

We misunderstood the rules. We thought that we can apply PR for our son anytime. Because my husband and I don´t live in the same country now, we think it might be good to apply PR for him after we settle down in Canada. We will definitly apply PR for our son as soon as everything is settle down. If we can continue our process by adding our son to our application, then we will be patient and wait for result. But if we are rejected because of this reason, and we have to start from scratch, then I guess that is it, we are not going to waste our time and money on a country which doesn´t welcome us.

The country will welcome you...BUT you have to follow the rules. Ignorance of the rules is no excuse.
I feel sorry for you but you must follow the rules.
Since you were denied entry, you should start over. Add the baby to the application wait and see what happens.

I would suggest consult with a good lawyer. There is a small chance that you might be able to save the visas by making only the principal applicant land now, and dependents later. You will have this time to aply for your sons PR. Also if your son is a US citizen, you might have more options. Things look difficult, but, definitely talk to a good experienced lawyer.

Thanks for all your replies.

Yes, I agree that it is our fault, we should apply PR for our son at the beginning. We are not intended not to follow the rules, we just followed the wrong rules. When we started our application, we have no baby yet and didn´t know we will have a baby. When baby was born, and we haven´t got AOR, we thought about informing Buffalo about our new born baby, and we asked friends who were applying PR at that time, we all told that we can apply PR for our son anytime in the future. (We should consult buffalo office, not friends, our big big mistake) Before we got AOR, we had to send our son to our home country living with his grandparents for some reasons. We just hope we can get our case approved, then apply PR for our son right away. But ...

Anyway, it is too late to explain everything. Read some posting, said that appealing is long and painful process, we are not sure if going to undertake this process.

The best thing you should do is find a way to clarify what is CIC´s decision on this. As you mentioned, your husband was informed to get PR application for your baby and you have to do medicals again. However, did he say you have to re-apply? It is hard to speculate. Either try to get a direct response from CIC or go through a lawyer. This will also save you from getting stressed too much over something you´re not sure if you have a chance or not. Let´s hope for the best. good luck!

Butterfly sorry to hear that. I think you better hire an attorney since this case is complicated enough that I doubt if you could get good advice from this board. That said, I think you may have callously and willfully disregarded the CIC rules: they clearly advice the applicants to inform them of change in family status and such matters... You should have used condoms or such to control the status if you did not want to bother to inform the CIC! Well, better seek legal advice from here on. It might help expedite your case.

The attorney is going to squeeze you a lot but looks liek you dont have an option... check with the attorney... also independently do your own research with CIC and see if you can keep the visa´s valid while you add your son.

Its going to take a lot of work but you have to do it...

Also take opinion of couple of lawyers/consultants before you get it done.

I agree with PARAG, may be we are optimistic and not sure if right!! I too would suggest that you consult a good (and reasonable) lawyer. There is still a chance that the principal applicant may be able to land now. Atleast if the principal applicant can keep the visa, the rest can be sponsored subsequently......which saves a lot of pain and time!!! Do you try this??

Every immigration website out there clearly states that you must notify CIC immediately about change in family status. that includes marriages. ´I did not know´ will not likely help change their mind. (PR applicants should take your situation very seriously, so it does not happen to them too- particularly those who get married and do not bother to notify CIC)

I would invest a set amount of time and money into appealing this situation. In the mean time, I would start gathering your documents etc so you can reapply as soon as possible.
