In order to apply from within canada in the spousal sponsorship category is it imperative that one has to have to have a record of entry or visas for canada ???
coz i am a canadian resident and i want to sponsor my spouse who is in canada and we live together.
My spouse does not have any visas or record of entry on his passport, since he came from across the border (united States) illegally into canada just so that we could marry and live together.
I know there has been a change in the sponsorship policy since february regarding status not being an issue, but reading through this forum gives me an impression that one has to have some kind of prior record of entry into canada (my spouse doesn´t have any on his pp)
Please advice .

Well. Are you married in Canada? Doyou have a legal marriage of certificate? If so you can sponser your spouse in Canada Class.

Yes, we were married in canada and also have a marriage certificate proving that, but the only problem is, my spouse does not have any records of entry or visas into canada since he crossed the border illegally from the United States.

No Pblm. You can sponser your spouse in some cases. did he illegal too in USA?

i encountered the same problem (almost similar!) mine was refused and sent back home voluntarily. I should have to re-apply to my home country
