Subject: Ukraine - need to save my brother and his family
  Good day,

My brother is currently in Ukraine with wife and two kids without job (all jobs stopped in the war area) and his apartment was ruined during war action in the east of Ukraine. He has a little bit of savings but it only gonna last for a couple of month. He wants to apply for asylum in Canada because he said he can be sent to war by the government against his will.

Any advice is appreciated as to what can be done to bring him and his family to Canada for asylum.

To qualify to apply for refugee status from outside of Canada he and his family will first have to be recognized as refugees by UNHCR. Without the UNHCR recognition, they can´t apply for refugee / asylum status from outside of Canada.

To apply for refugee status from within Canada, they need to apply and be approved for a tourist visa (Temporary Resident Permit) to Canada. Even if he is able to get to Canada, there´s a good chance CIC will refuse him since he could move to another part of Ukraine to get away from the violence. Saying he could be sent to war against his will won´t be accepted as an argument since it hasn´t happened.

If you really want to bring him to Canada, he should avoid going to refugee / asylum route (there´s a very low chance of success) and he should instead focus on trying to immigrate through the skilled worker program or one of the provincial nominee programs.

Very sound advice.

There is an internal flight option and many internal refugees are housed in LVIV.

Hey Sergly,

I agree in general with the post above. Its true that an internal flight option must be reasonable given the circumstances of the individual in question. example, it might be reasonable for a young men to travel to LVIV, but very difficult for an older man with family and kids to relocate.

I just answered another post and recommended my immigration lawyer. Google azzilawcorp.com. He is professional and was extremely helpful with my case.
