Subject: Deportation from Canada
  I just got rejected as a refugee claimant. I´m from a DCO, Hungary. I have a boyfriend, we´re living together since last December and I´m 8 months pregnant. We´re not married as yet but we´re working on the marriage licence. We want to apply for In Canada Spousal Sponsorship. We can prove that it´s a genuine relationship. (pictures, joint bank account, joint insurance, mails on the same address, friends can prove it as well and family members) We have a really short time to do something because Immigration is going to deport me.(I did not get the removal order as yet) I applied for the judicial review but it doesn´t look any good based on what I red about the success rates. I also red that in some cases people are allowed to apply on humanitarian and compassionate (H&C) grounds (best interest of a child). If immigration would deport me can I take my baby with me? Does the sponsorship application defer my removal? Would you have any advice in this situation?

If I called you a Dumb A**, would you get angry?

You have a Lawyer who probably lost your refugee claim convincing you that your claim had merit and that you should ask one decision maker Fed Court to overrule another decision maker IRB member because.....?

Now I know why you are asking her because you no longer believe what that Lawyer is shoveling.

Two paces of ID each to obtain a marriage license and since you paid the Lawyer for the LEAVE to appeal application at least $2K you can afford a marriage license. What work is there involved.

Deferral of Removal to Hungary are you Rob Ford´s buddy? Like what are you smoking?

There are plenty of ways to delay removal and if your eight months pregnant why stress yourself out paying this Lawyer a penny more.

When one waits to submit a spousal sponsorship application while she is eight months pregnant after living together for twelve months just to marry because they are (working on a marriage license) of course I would be in a high roll.

If your common law why wait for the marriage license? You already have a removal order the second you made a refugee claim.

Now timing is everything. You are making it look like your relationship is bogus by not tying the knot six months ago. Because you are "working on getting a marriage license" and probably will not get married until after the Federal Court rules that your LEAVE TO APPEAL has been refused. Your In-Canada Spousal Sponsorship will be refused as well.

The chance of CIC getting to your application before CBSA throws you on a plane, little to nil.

Also an application in for PR does not prevent CBSA from removing a person from Canada, only the federal court can defer your removal and I can´t see why would they?.


The whole way how you want to go ahead with this application / marriage license etc, looks weird and very questionable.

You are better off, leaving Canada, apply from outside of Canada for PR, apply for an authorization to return to Canada and start your life again. Otherwise, you are going to end up with a lot of frustration, spend lots of money and at the end being removed from the country. Your chances of staying here are slim to none.

DocD She will have a departure order only so if the kid is born she might be able to leave within the thirty days.
