Subject: Rejected Refugee Claim, H&C Application |

Hello everyone,
My boyfriend filed a refugee claim in 2008 and was rejected recently. I assume he will soon be sent a removal letter but in the meantime we are working on an H&C application. If we send in the application before the removal letter is filed and sent, does he have any options to stay in Canada while the H&C application is being assessed?
Thanks in advance!

(in reply to: Rejected Refugee Claim, H&C Application) No, an H&C application in process does not prevent a person from being removed from Canada.

(in reply to: Rejected Refugee Claim, H&C Application) Yes he can stay and renew his work permit, I know a friend who went through the same, but she never got harassed , all you need to do is to make a very strong case in your application, make sure you gather all the document and its good to have a lawyer do it for you. then brace yourself for many years waiting in limbo. otherwise your good for now as long as you stay out of trouble
