Subject: visa rejected for second time can I take to court
  Hi there,

I applied via the embassy in rome, with arranged employment, and the first time my PR was rejected due to English skills I was below 7 (or at least) this was what was on the letter.

Second time I applied through the same office, did the interview and medicals and my visa got rejected now because I was told the evidence provided for employment experience was not sufficient. I provided contract, pay stabs/slips (no EI/pension contribution because my employer in Bosnia did not declare me with the government to avoid taxes).

I was told I can take this to court because I have provided all proof I had for employment. What is the chance I can win the case or is this a crazy suggestion?!

Did you just provide the contract and pay slips? Or did you provide any other proof for your past employment?

I provided the contract when I applied and 4 months ago as per request of interviewer the pay slips and a post card I could find when married that it is

Where did you see that IELTS has to be below 7, what kind of immigration program did you apply...

how many years of work experience did you provide and what was your occupation

My IELTS for the first application was 6.3. I applied through arranged employment. I got a contract which was confirmed by HRDC... or a government agency and then I sent my first application. my profession is accountant.

second time I did better in IELTS exam got 6.7 points and applied for the same arranged employment contract, same category accountant, with 3 years work experience. Everything was OK and what I was asked after completing medicals I was invited for an interview in May and was requested to provide proof of employment. I provided paystabs however could not get pension or EI contributions because my employer did not declare me for tax purposes and this I did clarify with the interviewer. In early October I was advised that my application was rejected. I was advised by a friend to appeal the decision in a federal court? What kind of documents do I need to present and is this really an option????
