im legally married since 2002 no kids but separated, since ive got married i never change my status even in the Philippines still single status.. all my papers here in Canada is single., can i get marraid here or file a divorce first to my ex.. i need some advise please.. thanks a lot!

If you were legally married in your home country, you should´ve changed your status in Canada. The question is not if you were married in Canada, the questions is if you are or were married.
Get a divorce certificate and then you can get married in Canada.
