Subject: i need answers plz regarding sponsoring my wife
  Hello everyone

I am so confused about the process, I am Canadian living in Israel, I got my citizenship by naturalization, were I lived 5 years in Canada and then I returned to Israel.

Now I am thinking of moving back, my wife does not have a Canadian citizenship or permanent residency in Canada and never visited Canada before, while my son has by default the Canadian citizenship from me.

I have the following questions:

1- I want to return to Canada but I don´t have a job there or job offer, or property, but I will bring with me about 100,000 CAD to figure out opening a business there, does that qualify me to sponsor my wife

2- in the application form ( generic application form ) that I think my wife has to fill out (principal applicant ) it mentions dependent children, shall I fill that section for my son who already is a Canadian citizen

3- I am confused with the generic application form does my wife have to fill it or I, who is the principal applicant ( the sponsor or the person being sponsored )

4- I don´t have any connections with schools for my 7 year old child to attend in Canada and I read that there is a section to fill out in that regards, so what shall I do to be able to fill out that section, are there anything to do about it. Is it a must to have that available to sponsor my wife

You need serious assistance.

First submit last years Canadian Income Tax Assessment. Without the CRA´s Option C your wife will not become a Permanent Resident (PR).

On the basic application form IMM 008 it says clearly do not include dependents who have PR status or are Canadian citizens. Include him on the additional family information form.

Your wife is applying for (PR) status not you.

Your son will not be applying for a study permit so there is no such question about which school etc.

With $100,000.00 Canadian do you not think that you can afford an authorized Immigration adviser to ensure that your wifes application goes smoothly?

You can certainly be approved without providing CRA´s Option C if you have been living outside of Canada (I know several people who were approved without any issues). However as a substitute, you need to provide the income tax statement from your current country of residence or your pay deposit slips or some kind of other hard evidence to demonstrate your income.

I love it when anonymous challenges my interpretation of the Act.

It is not against the Law to owe money to Revenue Canada but it is against the Law to not file any Income Tax.

16. (1) A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.

39. A foreign national is inadmissible for financial reasons if they are or will be unable or unwilling to support themself or any other person who is dependent on them, and have not satisfied an officer that adequate arrangements for care and support, other than those that involve social assistance, have been made.

so what shall i do now, i never realized i should file for taxes while i am not in Canada, and my income in Israel is not that high to begin with

Hyke,

You can sponsor your wife. Just follow the instructions and fill the forms. It is clear. You have the right o bring your wife but you might wait for sometimes.

Do not pay a penny to the so called immigration lawyers. They have zero authority regarding to the decision by the CIC representative officers.

paying for lawarying is wast of money. And those lawyers are like vampires, they will take all your money if you show them. But like most you can do it as long as you are trustful

It is only your wife she is not important to you. You have only $100,000.00 you can´t afford to make the process to go a little more smoothly.

I agree with Bob risk her being refused then apply again, again, again and again. Or better yet appeal the spousal sponsorship refusal and represent yourself. Only idiots pay for legal advice.

Hyke if your case was a slam dunk I will still recommend you retain an experienced, knowledgeable representative. Look at it this way if you save a few pennies and your wife is refused because of your mistake "HOW MUCH HEADACHE WILL YOUR WIFE GIVE YOU"?
