Subject: Divorce with application still in process
  Hello
My son and I moved to Canada from The USA in August of 2009. I married a Canadian and we filed for inland spousal sponsorship in 2010. After a year or so we realized our marriage wouldn´t work. I moved into my own apartment and stayed in Canada. My husband said he would continue to sponsor me if I wanted to stay.
After a year I have met someone else. My application is still in process. My husband does not want to sponsor us, we both agree he shouldn´t, however the new someone would like to sponsor us.
Of course divorce is the first process. Where do I go from there?

Nothing is Hopeless.

If your still legally married but living common law with another for at least one year the new person can sponsor you as common law.

Do I need to wait before applying again with the common law someone? Can I keep applying for a work permit? Can we hire you to help us thru this?

You need to acquire a divorce certificate before proceeding with a new sponsor. You have to live with your new partner at least for one year. If you don´t know what you are doing you seek a professional help. Make sure you hire a legally authorized consultant! You may visit our website at www.clickimmigration.ca

Anyway,
You have to inform CIC that your marital status has changed and at this point, if you fail to do so, you can be accused of misrepresentation and then you will see how things can go down hill in a hurry.
I would withdraw the current application before a decision is made. Technically you were supposed to inform CIC after the separation happened.

Then you can apply under the new sponsorship if you meet the requirements and basically start all over again.

There is nothing in the law to prevent you from doing so. Except that you have to meet he conditions that define a "common-law"

There is a chance that during the transition, you won´t be able to extend your work permit until the second application moves forward.
