| Subject: How can I apply for the asylum in Canada? |

I am from Slovenia (Europe) and I have huge diffilcuties with my previous partner. Police can not protect me and my children, so we can just wait for him to come out from the jail and do to us what he had promised (death threaths) to me and my children... My brother lives in Canada so I would like to ask if it is possible for me and my kids to move there as a refugees (to apply for the asylum) and what do we have to do. We canīt apply for visas because previous partner has to sign the documents and he absolitely wonīt do that... Thank you.

You can´t apply for asylum from Slovenia. You would have to come to Canada and ask for asylum when you arrive. So there is really no way to get around the visit visa requirement.
Even if you are able to obtain visit visas and claim asylum at the border when you arrive in Canada, your situation is not grounds for being granted asylum in Canada. In other words, while the situation you are in is terrible, you don´t qualify for asylum and should expect to be refused.

Slovenia is visa exempt for tourists but you could still probably be asked to provide consent with respect to your children. Slovenia is on the safe country list as it is part of the EU so it is almost impossible to be accepted as a refugee from there. Have you considered moving to another country in the EU. The problem of consent by the children`s father would still apply of course but if your partner is in jail for making threats against you, it would seem possible to get sole custody or other court order or forms of protection.

What about other european countries that you are allowed to live in as a EU citizen. This is the first and last question that a judge will ask you .
