How does a permitted worker get a divorce?

Subject: How does a permitted worker get a divorce?
  My girlfriend is living in BC and has a work permit. She was married years ago in the Philipines and never got around to getting an annulment. Her ex spouse now lives in Korea and she has no contact with him. There is also a child involved but the ex spouse has no contact with the child either.
Where do we start? Any advice would be greatly appreciated.

There is no divorce in the phills. Annulments are very difficult to get. I do not know what other options she has other than gaining pr then citizenship then she can apply for a divorce in canada. It would not be legal in her home country though.

No - she can´t legally marry in Canada.

The Canada divorce act states a divorce is legal if you apply in the country you normally reside. You do not need to be a PR or a Citizen to file for divorce in Canada. Send notice to the place of last known residence and if no response file for divorce.

Any person living common-law can submit a Spousal Application even if they are legally married and they will be approved if the relationship is genuine.

With the exception of Quebec residents I believe? Quebec does not recognize common-law.
