I have been assisting clients with their applications and dealing with violators of the Immigration Act and Regulations for thirty plus years. I have been answering questions and posting Immigration topics for discussion here for at least five years on a fairly regular basis.

If (URGENT PROCESSING)is not in the Act or the Regulations it does not exist and therefore can´t be referred to in the manuals.

I have never seen anyone who has been so wrong and told by others that they are wrong and then can not or will not defend their position with any evidence that they claim exists. Instead they attack.

Most posts on this and other Immigration forum/discussion groups are about (how long) when will this happen? I get that, of course processing times is a major concern.

I try my best to correct false information regarding Immigration when ever I see it. An objective of the Act is prompt processing and for years I have won H&C cases based on cases not complying with the objectives of the Act and the Regulations.

My clients Ming Chen and Yan Chen have not hugged their 16 year old daughter in 16 years. She will be arriving at the beginning of March 2013. They made a refugee claim based on China´s Family planning policy after the Chinese authorities tried to sterilize them both, they lost. CIC transferred his H&C application to the PRRA unit and did not deal with it for six years.

Compassion has to be common sense!!!!

If you are a Canadian citizen who was residing with your partner in a foreign country you could have sponsored your husband while living with him. You had to be aware of upcoming problems in his country. If you are a permanent resident you´re in violation of residency requirements.

Try just googling my name with the word Immigration then compare what you find with others in my business. I am confident you will find many more recent media stories confirming my ability and knowledge.

Yes Sara people come here to gain insight, to ask questions to get help - not to be misled.

When others are adamant that they are correct when they are wrong, should not someone with knowledge like anonymous ***205.241.253 did stand up and say, you´re wrong? I don´t know that person but felt they needed defending.

Why they did not stand up to your attack I don´t know but I am not shy.

I never said A 4.1 I wrote regulation 4.1 here is my quote. "The more trouble in any applicants homeland the greater the chance of a refusal based on Regulation 4.1". I was stating a fact based on decades of experience, here is the regulation.

4. (1) For the purposes of these Regulations, a foreign national shall not be considered a spouse, a common-law partner or a conjugal partner of a person if the marriage, common-law partnership or conjugal partnership

(a) was entered into primarily for the purpose of acquiring any status or privilege under the Act; or

(b) is not genuine.

To all those that have a little knowledge and wish to submit their own DIY Spousal Sponsorship, best of luck.

Remember: It is your responsibility to prove that your partner and you are in a genuine relationship and that the applicant is not out to use you. Do not think for a second that if after a considerable period of time you as a Canadian residing with your partner in their country that CIC will care one bit about his/her safety if troubles break out. Your partners application will be put in the pile and CIC will get to it when they get to it regardless of problems.

IRPA Section 3 (3) (d) "ensures that decisions taken under this Act are consistent with the Canadian Charter of Rights and Freedoms, including its principles of EQUALITY and freedom from discrimination and of the equality of English and French as the official languages of Canada;

The Immigration Act requires all decisions to comply with the Charter provisions on Equality and your specific case can not be treated more "urgently" then others.

With regards to being told I am wrong. There have been 2 people that have said it. You and Anonymous. I kindly thanked him/her and said I know there is.

I then referred to the manuals, and that I have spoken with an agent at CIC.

I did not "attack" anyone. I will say though to Anonymous: If I offended you I did not mean to, for that I am sorry.

I did however stand up for myself to you and your assumptions.

Again, I will not post the information I have. I am being selfish. It is not that I cannot back up my words, it is that I choose not too. I came asking for anyone that knew of it to share information on what is required, if it makes things harder ect.. You do not know anything about it, as you did not know it existed. I get the share the knowledge thing, but at this time I have supplied all I am willing too.

I believe if it was common knowledge then every Tom, Dick, and Harry would be trying to do it. How much harder would that make it for CIC and the IOs?

They then would be trying to determine the genuineness of the relationship as well as going further having to looking into the basis of the urgency... Good Lord! Imagine the spike in processing times!

I am a Canadian born and bred. We were intending to live there permanently, so had no thoughts of sponsoring what so ever. We had no warning of problems while living in his country. When things turned bad (we then realized what we would be facing as far as immigration goes) we waited for a calm in the storm so to speak, I returned with our children.

I do not have any residency requirements, so that is all good. Thank you for not assuming.

I stand corrected on the Act versus Regulation part. Thank you for noting my mistake. I do not believe after 8 years of being in a relationship(4 of which we have been married as well as living together in his country for 5) that they will find any evidence with regards to our relationship being genuine or being entered to simply gain status.

In response to the everyone is treated fairly jargon, I can only tell you that I do not for a second believe that is how CIC operates.

I have seen many different cases where it is not so, as I am sure you have.

I have seen some cases put together by applicants whose native language is not English, and this causes delays. That is normal as far as I can see it. It is not a equality factor, but merely that it makes it difficult for the IO to interpret. Perhaps documents are missing ect. That is where someone like you comes in and would be beneficial to use services such as you are offering.

I also realize that access or availability is a factor with regards to background security checks and the like.

Yet, I still cannot comprehend the processing times. I know I am going to have to "hurry up and wait" whether the request for urgent processing goes through or not. It still is going to be a significant amount of time.

My heart goes out to the couple you mentioned, I wish for them to hold their daughter soon! I can only imagine how they must feel, and it breaks my heart.

There is obviously some information missing however. I wonder how it is they got separated from their child? I know you would have to kill me before I would leave either of mine...I do not mean to imply anything, I am only stating a fact about myself. I, like I said do not have all the information regarding them or the case.

Do you specialize in H&C applications? I read your website, I got the gist that you mostly deal with them, this is why I am asking.

I understand that you feel my information is unfounded, as I have not supplied as you say, proper proof.

In no way have I misled anyone with regards to this or anything else I have said. I have also suggested that the persons reading my posts find a website called canadianvisa it is a very informative forum where a person can meet and talk to others in the same situations as themselves. A few of the members actually work for CIC and are very helpful.
