Subject: removal order: please help
  dear mr roy,me and my husband is a refugee claimant which our case had been rejected. both our refugee stories are the same but different status. he applied for H&C and PRRA. and me applied for refugee claimant. i doesn´t wants to confuse you with all this things because its a very long story. as what the cbsa officer said our case is very special and unique. let me explain to you what happen: we receive a letter from cbsa ask us to come and meet the officer today, they explain to us that my husband is facing a removal order which i don´t understand whether its a exclusion or deportation order. she gave my husband a date line until this 30th march but he have to and meet officer in two weeks times to make sure whether its a deportation or exclusion order and also with tickets and routes. for me no removal order because i applied for my judicial review. now my question can my husband get a stay for his removal? and we also have Canadian born baby which is four months old now. currently we are living in Alberta fort mc murray. and my husband is working in Suncor oil sands as a welder. im working too but currently on maternity leave. we are not taking any social assistance too. I´m a licence practical nurse in Malaysia and i completed my health care aide diploma here, as well my husband is doing his electrician diploma online now which is going to finish in few weeks times. we really improve our self in Canada. but i have no idea why this things is happening to us. in my husbands prra application i notice that some proof which I´m having now is not included. i have paid about 10,000 thousand to my lawyer since 2011 but I´m really no satisfy at all even the cbsa officer herself told us my lawyer is not a good one. with all the information that i gave please let me know if you can help me and how much the cost is going to be? and can i change my lawyer to Toronto while I´m in Alberta? if you need further more details about my case please let me know i will scan and email them for you. I´m really so worried and i really need your help and believe that you can help us for the sake of my baby, she is very precious baby bcs she born after seven years we got married and we wants give her good future and life in Canada. please help me.

Trade certification is compulsory in Alberta and available, but voluntary, in all other provinces and the territories. NEVER LOSE YOUR CERTIFICATION.

We won a welders H&C last October. I let potential clients speak to former clients. Their approval took two months.

You can also submit a H&C application for landing based on the Best Interest of the Child, common sense, welder etc. no waiting period depending on your personal situation.

If no one can keep you here we can bring both of you and you back.

Filing an application for (leave to appeal) your negative decision on your refugee claim is like submitting a resume and hoping for an interview. So few ever get permission to appeal. Fewer still win their appeals.

You ran out of time, chances of getting your husband´s removal cancelled are slim to none.

Really? you don´t? I could tell you but my year´s resolution is to be sweeter so I won´t.

Back to the point. It comes down to basically two options:

1- Both of you leave the country and come back under either a work permit or a PNP.

2- Your husband is going to be removed from Canada, regardless if he is going to be removed with an exclusion order or deported, he still needs an ARC in order to come back.

YOU could have a chance applying under an H&C based on the best interest of the child. BUT it is up to you to prove it. Once that is in place, you could bring your husband back.

Keep in mind though that an H&C in process does not prevent your deportation either.

Either way, play your cards wisely.

DocD being sweeter this year, really.

Is this one of your own files DocD you being in Alberta?

Most people who obtain an ARC receive one because they were suggested to make a frivolous refugee claim bvy someone else and finally admit that they knew better or should have known better.

Informing any CBSA person like DocD you don´t know how you got yourself in this mess will make him turn red with anger. Compassion has to be logical.

$10K to deal with two separate refugee claims including an application for leave to the Federal court is a bargain.

Your husband can file a stay motion with the Federal court which will get him another 4-5 months in Canada at approximately $1,000.00 per month. The question has to be is it worth it?

Hi Roy
My husband is current at the Toronto holding center on a removal order. He is frm Jamaica and came to Canada two years ago to work on the farm and he left off the farm, so there was a warrant out for him. We got married earlier this year got a consultant to submit his sponsorship, the consultant adviced us that he has to go out airport road to get the warrant executed.... The sponsorship papers were sent but not being process yet. So they kept my husband denied bail twice´. What is the best thing for us to do I this situation. We also have a 3 week old baby. My hubby is there now since the 23

A better bonds person is one option but the best is assist with sending him home - withdraw the In-land sponsorship then submit an overseas sponsorship.

I used to be in charge of the IHC Immigration Holding Centre & was the supervisor of the detained unit assigning hearings officers to do various detention reviews. We have never lost an ARC authorization to return application. Jamaica is slow but some times the best route is the longest way around.
