Subject: Need help!
I am an Australian citizen, I have been in Canada for 4 years on a working holiday permit, which expired in Jun 2012. Before it expired I applied for PR on an inland spousal application as I am married to a Canadian. I did not also apply for any type of open work permit at the time I applied for the PR, because I´m not working anyway, I´m staying at home looking after my 8 month old son, and my husband supports us.

We are going back to Australia in October for a family committment that we absolutely cannot back out of now. It was organized a year ago, and I know it´s best not to leave the country, but I didn´t know that at the time. So what happens when I come back in? I will have my baby and my husband with me. We have not heard back about the PR yet.

Any help would be appreciated. My family is going crazy thinking that I have not done it right, and perhaps I haven´t, but I would just love some clear answers.

Thank you.

You made a mistake applying through Vegreville especially since you didn´t even capitalize on the eligibility for an open work permit.
Don´t leave Canada at this point.
Your temporary resident status is valid only as long as you are in Canada. You leave the country you lose it which can lead to a closure of your sponsorship file. And it happened to people. If you come back without an immigration visa with the intention to reside in the country not for a temporary purpose you can have a problem. If they wish to take a harsh stance they can say " why did you ask for exemption from the immigration visa requirement if you can leave the country and go to your home country?"
If you have to take the risk just be ready to submit a new application through Mississuaga-Sydney, the way you should have done the first place.

Amir,

Well, I did leave Canada, which was for my wedding by the way, which is why I explicitly said I couldn´t cancel the commitment. I came back in through Vancouver, I explained my situation, and there was no problem whatsoever. I was issued a visitor´s visa, and now I am back home in Canada, and I´m also now applying for my open work permit.

Thanks for nothing bozo. Your information was incorrect.

Regards,
Anna.
