PR under Humanitarian and Compassionate grounds

Subject: PR under Humanitarian and Compassionate grounds
  Hi, I got a question regarding PR application for my son, applying from within Canada based on Humanitarian and Compassionate grounds.

Just a brief info about our situation: Because we do not fulfil the residency obligation with respect to a five-year period, So when we applied my son´s PR as he was born outside Canada, it automatically falls under H & C Category.

We renewed our PR Card after we stayed here 2 years and finally after the interview, our PR card was renewed and our status is cleared now. So the CIC started processing my son´s PR application. First stage approval has been made, and he did the medical check already.

So my question now, one of the requirement of the Immigration and Refugee Protection Act is that you are self-supporting (not in receipt of social assistance or welfare benefits). I actually have send application to apply CCTB and UCCB for my son. Are CCTB and UCCB considered as social assistance or welfare benefits?

I got my PR for Canada in May 2009 I stayed there until July 2009. I have to come back to Australia due to some commitments and never gone back which I never wanted. I got married in May 2010 when I was about to migrate to Canada from Australia unfortunately I got some differences with my spouse and in April 2012 I got Divorced then there was some financial dispute as well with my wife. I was looking to resolve that dispute through mediators
now in April 2013 both I and my ex wife lost rights for making any legal claim for financial dispute.Now I am ready to migrate back to Canada. I was also going through emotional distress due to breakdown of my marriage. On health
grounds I also preferred not to migrate back to Canada in April 2012.


On 5 th of July 2012 I was out of Canada for more then 1095 days and I cannot met my Canadian Residency Obligations now but I want to make an appeal under Humanitarian Grounds that I was out the country to save my marriage, financial dispute after divorce and on health grounds due to depression and stress after marriage breakdown. for that reasons I need some extension to meet my residency obligations. Can you advice me anything in regards to this.

Katarina,
For CCTB and UCB the child´s status is not relevant. The parent who is the primary caregiver has to be eligible for it, I´m not sure why you didnt receive this information earlier. You could have qualified for CCTB and UCB ever since your status was cleared. Please check again, hopefully you did receive everything since.
