Subject: Refusal of spousal sponsorship
  I am an Canadian living in Hong Kong. My husband and I were planning to move back to Canada so we filed for the spousal sponsorship. I was approved as being a sponsor then our application were forwarded to the Hong Kong consulate. Soon after we got a letter saying we need to provide proof that I have the intention of moving back but the things that they were asking for were resignation of my job, closure of bank account ect. Since the approximate time for everything to be processed would take about 18 months as it says on the website, so there is no way I could just quit my job and wait for their reply. I provided letters from work, from my friends and family here explaining that I have the total intention to return as well a letter provided by me explaining my situation. However, yesterday we received a package along with the refusal letter saying that we got rejected because we couldn´t satisfy the requirement for returning back to Canada. We are just devastated now that we dont know what to do. The funny thing was they spelled my name wrong and they send us back our photos and files but along with it were some other people pictures as well. It felt like they just glance quickly and decided without much consideration. Now I regret not quitting my job even though it seems so ridiculous that we still have our living costs here but my question is if I quit my job now providing my resignation letter, closure of my bank account would I be able to submit it again for the consulate to look over again and reconsidered or should I just go for appeal but I am not sure if for the appeal applies only for those Canadian living in Canada. The other two options are I would have to come back and find a job first but that is just forcing us to be apart of each other. The other option is we come back together but he won´t be able to work for 2 years or more until it´s approved but it doesn´t guarantee his approval. The other thing I´m not sure is maybe he could get a working visa first then we can both move here and wait until it get process. We just dont want to live apart as long as he can work while we wait then its alright. Can anyone tell me what I can do now? I am lost and I dont quite know the process too well, the consulate won´t even answer any of my questions as well as the call center agent. Please help.

That´s crap.

Lorraine,

Actually the appeal process is available for outland applications like yours.

If a Canadian citizen or permanent resident makes an application to sponsor a foreign national as
a member of the family class, and the application is refused, the sponsor may appeal the refusal.

OP 21 Appeals

If you do so, try to find a job and include the offer with the application, showing that you have the intention to return and settle in Canada. Even a lease agreement will do it.

If you feel that you need an immigration consultant, then that is up to you. You don´t have to.
Get plenty of references if you do. kepp in mind that 80% of them are full of crap and the other 15% are eaten alive in the hearings so that only leaves with a 5% or less that can actually help. You would have to do the research though.
