Subject: Sponsor adopted brother...
  My wife and I are planning to sponsor two of her adopted brothers. They were adopted by my wife´s mom when they were just babies. Both of there birth certificates were transferred to the family´s name, also, both of my wife´s parents were used as the legal guardians/ parents. They are both under 18 years of age.
My wife´s parents separated when they were just little kids but not legally(divorce), the dad left them. They hardly hear from him and was never there for them. When my wife, her mom and other siblings migrated here in Canada, the two brothers got left behind with the care of her other older sister. Unfortunately, my wife´s mom passed away and the older sister could no longer take care of the two bothers.
We are both Canadian citizen and our combine income are enough for sponsorship. My question is can we sponsor the two adopted brothers under the section of other relatives? They are technically orphaned in a sense that the dad was never in the picture the time when they were growing up. If anyone can leave a comment or offer some advise, much appreciated. One of the brother will be turning 18 this year and I want to forward our application asap. Thanks.

They aren´t orphans if their father is still alive (regardless of how involved or uninvolved he is in their lives).

Thank you for your replied. Well, he´s not really the father because they were adopted by my wife´s mom and during the time they were already separated. He was only included in the birth certificate for I´m not sure what reasons. Is there any way to prove this, from what info I gathered my wife´s mom was a single mom during the time. I only found out about the dad when I requested the birth certificate back home.

More info:

late 80´s/ early 90´s parents seperated
*1994 Dec - older brother date of birth *adopted by wife´s mom at the same date*
*1997 Mar - younger brother date of birth *adopted by wife´s mom at the same date*
*2001 May - wife´s mom came to Canada - brothers was left behind under custody of the older daughter( wife´s sister)
*2003 Dec - wife´s mom passed away
*2003-2012 brothers grew up under the older sister guardianship...
*2012 - sister could no longer take care of the two brothers, asked if we can sponsor them

Can you explain what you mean by the following (taken from your original post)?

This information seems to contradict the information you provided in your most recent post.

lol...I know what you mean. I didn´t quite get it at first when my wife explained this to me too.

Here´s the case. Those two brothers were "adopted" at birth, (no actual documents of the adoption) older brother was actually abandoned by his biological mother to my wife´s mom when he was a baby. When the older brother birth certificate was filed it was my wife´s parent names were used as they were the actual biological parents. In papers, legally they are being recognized as they were the actual parents. Younger brother case was almost identical except the biological mother was staying with them at the time for a couple of years, until she decided to abandoned her child to my wife´s mom as well. Exact same thing with the birth certificate. The only problem I see is the dad being alive, but really he´s not the father of them both. The brothers grew up thinking their "real" parent was my wife´s mom. And my wife´s mom treated them as her sons too. The dad was never in the picture, like I said they were separated at the time. This is what I´m confuse about, How do I show proof that these two brothers are actually orphaned? As the wife´s mom and the older sister were the parent/ guardians when they were growing up since little. What kind of documentations do I need to provide the immigration for them to qualify the brothers as orphan relatives? I know death certificate for the mom but...I don´t know the dad´s role here, as like I said really not the biological father or acted as the legal guardian for both, except his name listed on the birth certificates.

no adoption papers and no DNA match - I think you are going to have a problem. Too often families magically grow in size when it is time to immigrate to Canada and CIC will be watching for this.
