Subject: Refugee Claim Rejected
  If your refugee claim is refused and the appeal to the federal court is also rejected and if you do not leave right away does it turn into a deportation order? My friend has been called to an interview at the airport what are the chances that he will get deported on the day of the interview? She is planning to marry this girl that he dated for a year do you think his girlfriend can still do an inland sponsor or does he has to leave canada. Thanks everyone for helping me out!

Hey tell your friend not to be despair.Tell him to make sure he goes in for the interview. The interview should be about PRRA application. That is the last stage for him to fight the battle. What was he waiting for all this while before his appeal was treated. Why didn´t he marry the same girl he has been dating for a year or so. Hmmmmm i smell a foul play in this story. Nevertheless,he´ll proceed to the interview room, and he´ll be giving a PRRA application. He´ll have to submit the first part(application form)of it in 15 days. The any other documents to strengthening his claims. He can submit both during the first 15 days, but it would be wise if you can calm down and get better documents to back it up. Note: The application can be process in the next 15 days after it was submitted. The better he start putting up his new evidence; the better for him. Again if there was any documents that was not submitted during the initial refugee claim or appeal, he can do that not; but he´ll have to convince the office why they were not submitted or available at the time he had his refugee hearing and appeal. The chances is so slim. PRRA can be decided in two to six months. You can have luck and it stayed a year or two. If their relationship is real, then let them push it in ASAP. Time is not on his side any longer....I hope this helps? I am not a lawyer, but I´ve been through this processing. Let him get a better lawyer that can fight for him. Did he applied for H&C? How do you know that the interview is about the PRRA application cause the letter did not state that. Their relationship is real they have lots of evidence to prove that their relationship is real but is it too late for them to get marry and do an inland sponsor?

Public policy regarding In-Canada spousal sponsorship DOES NOT defer your removal unless you have submitted your spousal application prior to being called to the PRRA based on the date the letter is typed.

Now that said if he is from a particular country and he has no passport the marriage application could be looked at before he is actually on a plane. It depends on several variables and it might not be too late.

If they remove him he would then have to cancel the In-Canada spousal and do an overseas spousal requesting an ARC.

Thank you Roy, does the departure order comes immediately into affact after his refugee claim is refused? So he would need an ARC to come back to Canada even if he now leaves Canada volunteraily?

Get married asap and send in the sponsorship forms. Once PRAA is discussed, you´ll be going back to your home country. Go and get married and mail in the forms quickly. You need to have all of this done before you go in for that interview.

He went to the interview today, but were not offered PRAA. They only told him that he needs to report to CBSA on monthly basis. Do you think they still have a chance of getting married and do an inland sponsor?

They are planning his removal. Not getting the PRAA is a good thing. Gives him more time to get married and submit his spousal sponsorship docs.

Do they mail you the PRAA forms or they will only give you the forms during the interview
