Subject: Can my in-law stop me from entering in Canada?
I´m a permanent resident of Canada. I become PR on June 8,2008 and resided there till April 30,2010 excluding 40 days which I spent to visit my home country in the end of 2009. I was sponsored by my spouse who´s a Canadian citizen but now we´re officially separated. I´m still at back home since then and now I´m planning to return to Canada as my PR status going to expire on June 29, 2013. So here are the questions:

1. Can my father in law stop me from entering to Canada just because of personal disliking? As he said to me that I´ve your PR id#(not card) which I´ve given to Immigration Canada long time ago, so you can´t come back but I´ve heard that nobody can stop any PR unless if somebody have involved in any criminal act or have their PR card expired or any other genuine reason.

2. Will I be eligible for the renewal of PR card? If I´ll return in the month of Feb, 2013 and after spending three months and few days, I´ll complete my 2 years from 5 years.

Please help me guys.

As a PR you have the right to enter Canada PERIOD. The only thing in question would be if you met your residency requirements. That being said, you can still enter Canada and deal with that if needed.

What your father in-law can do is tell CIC that you use a Canadian citizen to gain a PR status also known as MOC (marriage of convenience) if that is the case. That is a separate story. Either way it seems that you can enter the country.

BTW Your PR doesn´t expire in 2013. What expires in 2013 is your CARD. These two are two separate things.

What if above is not the case because the marriage was arranged and was between the two close relatives.

As DocD, your father-in-law can report the fraud case of Marriage of Convenience. CIC will do their investigation and if CIC determines you fraudulently entered the marriage for the purpose of gaining Canadian residency, CIC can revoke your PR. CIC has recently strengthen their law regarding fraud MOC cases.

In such pre-arranged marriages, it is even more easy to prove marriage fraud; sometimes, brothers and sisters married so they could enter Canada as immigrants; so your fraud will be similarly exposed and you will, most likely, be led to jail and processed for fraud and soon enough deported, with a perma ban on re-entry. Take my advice: just stay home, find some good employment and live life.

How can somebody call this marriage a fraud as it happened because of her parent´s consent and they´re the one´s who gave the proposal and they´re the ones responsible for break up also. My ex father-in-law did his daughter(my ex-wife) paper work for sponsoring me and later it didn´t workout so he become my enemy. My application was so solid that they didn´t even call me for interview and sent the passport with visa direct at home because I provided them all proofs with my application. If it was fraud I shouldn´t had left Canada even after we break up. I left just because I was heart broken and my parents were in stress.

Omair, being a PR, if you want to return to Canada then do so without making a fuss about it...If your ex in-laws will do what they threatened they will do, then wait for that and act accordingly...be ready with any supporting documentation u have to prove urself...
