Subject: H & C or PNP Possibility? - Please respond
  Background - person has applied H & C and have been denied & have done PRAA & is also denied.

Person has a Canadian born child and as such CBSA is in the process of getting permission for the child to go home with the mother on a one way ticket since the child is not a citizen of the country to which they are being sent

The child is in school and does not know any other life than living in Canada and this transition is going to be difficult on the child.


Can the mother make another application for H & C?

What options does the mother have in terms of applying for permanent residence here in Canada?

Based on the situation can the mother try the PNP and can this be done from within Canada considering she does not have legal status?

Nope it is done. That is pretty much the end of the road. She will be removed from Canada.

She may try to apply from outside of Canada.

I have been accused of being blunt before but you come on common sense. Anyone can apply for anything with CIC the issue is will they win and will CIC even look at it before their removal scheduled date.

Now if the biological father´s name is on the birth certificate Passport Canada will not issue a Canadian passport for the child.

No PNP will consider an application until after the person has been removed and even then they will require an ARC.

This person is like most of my clients they love the fancy office and nice suits of others but can´t realize H&C and PRRA applications are based on evidence. They retain the huge Law Firm and do not realize the high school graduate is the one that actually worked on their applications.

Hi Roy

That is exactly my point, at this stage their scheduled removal date is going to be way sooner than any decision on a second round of applications.

I partly agree with you but I have client(s) who have their removal on hold one for two years because they can´t remove them due to the biological father refusing to sign a Canadian Passport application for the child(ren).

Their H&C applications I did have now been transferred to the Local CIC Office and should be soon looked at.

The only option is for her to apply for H&C and she will have to show why her situation is EXCEPTIONAL.

Not as difficult as it sounds.
