Subject: 2 weddings
I am a Canadian born and raised and am engaged to a woman from Czech R. We are getting married in June 2012 in the Czech R. My fiancee currently holds a multiple entry visa for Canada that is valid for 3 more years. My question is this: Can she come to Canada on her current visa after we are married in the Czech R? We are thinking of coming back to Canada and getting married again by a Justice of the Peace in Alberta and then my fiancee could apply for her PR card. Are we breaking any laws by doing this?

Any and all help is appreciated.

She is entering Canada as a visitor, but she will apply PR within Canada(inland spousal application)

She is entering Canada as a visitor, but she will leave at then end of her stay because she will file oversea spousal application.

Why are you getting married twice?

You can marry her in the Czech Republic and register your marriage in Alberta.

Now as for entering Canada.

Her visitor´s visa is meant to visit Canada not to stay in Canada. When you come in with your wife, the officer is going to verify that she is going indeed to leave Canada at the end of her visit. Return ticket, ties to her home country, what is the plan while visiting Canada, money for the trip etc. At the moment that things look and/or smell like she is planning to stay to apply for PR there is a high chance that she may be refused of entry into the country and her visa might be cancelled on the spot.

Or, she gets a conditional entry where is required to leave in less than six months OR you are going to have to pay a bond to assure that she will leave Canada within a period of time (at the officer´s discretion).

What you should actually do, is to get married in the Cz.R and apply for her PR from outside of Canada. Follow the law like everyone else. In-land applications is something that CIC is not a big fan of...thus CBSA has the mandate to minimize them as much as possible.

1- She can remain in Cz.R until the application is approved then she legally immigrate to Canada.

A visitor´s visa does not guarantee her entry into Canada and if her visa gets cancelled and she is refused of entry, things can complicate her PR application.

Too many people do it, too many failed. It is not a pretty thing to see your spouse detained, locked up and removed next day.

Thanks DocD, you´ve been a big help. One more question then. From what i am reading on immigration Canada´s website, if we do apply for the PR card outside of Canada, then she will still be able to visit Canada while the PR card is being processed, correct? We wanted to spend a month or 2 in Canada after the wedding for a vacation and to visit. Then after that, we go back to CZ to wait for the application to be processed.
Thanks again, i have a hard time understanding the gov websites and your clarification has been a big help.

don´t get your hopes up about a visit mid process. Too many people have spoiled it for those who play by the rules. Once your application has been started I would not count on a TV application being approved.

Thanks Sharon,
But she already has a temp visa and to qoute CIC, under "Sponsoring your Spouse" and "Applying Outside Canada":
"you can leave and re-enter Canada while your application is being processed as long as you meet all requirements to enter Canada".
Unless i misunderstand that statement.
Maybe Sponsoring and Permanent Resident are 2 different things?
That´s why i´m on here, too understand better and i appreciate everyone taking the time to answer.
