Subject: conjugal partner sponsor
Please give some advise for my special case:

I and my wife with children are all Canada PR living in Canada now. I plan to sponsor my illegitimate daughter and her biological mother to come to Ca as PR. Before we got PR and first landed in Canada, we were all living together, two of them helping each other taking care of the children. My this illegitimate daughter was born after I first landed in Canada.

Under this situation, I shall sponsor her biological mother as my common-law or conjugal partner?

Right in Canada I am unemployed and don´t have the first year tax report either, I only have regular oversea rental income. Can I sponsor two of them?

My wife and I are considering two option now:
1. apply for her as live-in-caregiver, as for our daughter, she has to give up her custody in order for me to sponsor our daughter as dependent child to come as PR.
2. I sponsor her as conjugal or common-law partner with our daughter together, which is faster way to reunion if we can do so.

So which is the right approach for our situation? If we choose to apply two option at the same time, what will be the consequences, rejected both or have to choose one?

For those who have the similar experience or have the knowledge, please please help. Thanks a lot

you cannot sponsor the mother of the child. You can adopt the child once you prove paternity.

However, that will mean your adopted daughter would give up future rights to sponsor her Mom once she reaches the age on 19.

One wife only in Canada. Those are the rules.

As Sharon said - option #2 is impossible. Canada does not recognize polygamy.

For options #1 to work - the biologial mother will either have to have recently completed a course that qualfies her to be a live-in caregiver or have relevant experience.

Just to add - you must be able to show sufficient income to qualify to hire a foreign live-in caregiver. It doesn´t sound like you would qualify right now. See the following page of the CIC for full requirement details:

sponsor child (in reply to: conjugal partner sponsor)
Thanks sharon and those who responsed.

The biological mother is a nurse, I hope it will help for her live in care giver application.

Seems I can only choose to sponsor the child. But I don´t understand, I am the biological father, and I declared on the birth certificate. What else do I need to prove for the paternity relationship? Do I need a DNA test?

I am the biological father, why do I still need to "adopt". What will be produced for the adoption? The biological mother write a letter to claim to give up the custody will be enough? Or have to go through lawyer in her country?

Thanks

sponsor dependent child (in reply to: conjugal partner sponsor)
We have regular income as my wife just got employed as a registered nurse. So I guess we can qualify to hire a live in care giver.

Must I go through adoption to sponsor the dependent child? Or just need her mother to give up custody and make a claim will do? I am not sure what is the difference?

Do I need to go back to the country to proceed the adoption? Do we need to go through a lawyer or/and the country´s family court? Or by just using the forms provided from the Canada immigration will do?

Thanks a lot

If you bring her as a live-in caregiver, you will be required to pay her a salary. The wages for each province are posted here:

http://www.hrsdc.gc.ca/eng/workplaceskills/foreign_workers/advertReq/wageadreq.shtml#tphp

You and your wife must make sufficient income to cover this salary as well as your own living expenses.

You didn´t include your daughter when you first applied to become a PR, so you have no rights to sponsor anyone. As for your so-called common in law, that is illegal in this country.

You are already married, there is no common law or second wife here. That would be a good ticket to get you arrested.

Thanks for your advise DocD

My this daughter was born after I got PR and first landed. So I assume she still can be sponsored by me?

As long as the current legal guardian gives you permission so you can have full custody of your child. There is no chance that you can sponsor the mother though.
