To All
Even if you´re in a genuine marriage you still need a valid passport to be Landed within Canada based on Public Policy if your an overstay or failed refugee claimant.
The only way someone can obtain Permanent Residency status without a Passport from within Canada is when they have an original document of identity from their country of Citizenship and after applying under A25 or Humanitarian and Compassionate factors.
Bogus Potential Client INFO
Yesterday I had some bogus client´s come for a Consultation.
He claimed he could not obtain a Passport because he had not done his military service in his country of Nationality and that he had been illegal in Canada since he was a minor.
He wanted me to assist him with an In-Canada Spousal application. He wanted to do all the forms himself and have us check over his work and he would pay us for that. LOL
He claimed a Law Society of Upper Canada Immigration Specialist (________) submitted a Common-Law based spousal application previously but his Sponsor withdrew her undertaking. He then made a Refugee claim to delay his removal. Not with us.
NO IMMIGRATION BASED LAWYER WOULD SUBMIT SUCH AN APPLICATION IF THE PERSON COULD NOT OBTAIN OR DID NOT HAVE A PASSPORT!
Then this individual (couple) were informed of this information on the generic IMM 008 Application for Permanent Residency applicants.
***"I understand any false statements or concealment of a material fact may result in my exclusion from Canada and may be grounds for my prosecution or removal".***
I told him he could face removal for misrepresentation by not disclosing he had a paid representative. I also told him I would not review forms and our price is our price. I informed him due to his actions it would be highly likely that him and his spouse would be interviewed.
This couple were so PHONY they smelled all the way across the room. I do not believe for a minute that they were in anyway potential client´s.
I feel bad that deserving client´s of mine did not get my attention because of these bogus people.
These individuals (trolls) follow this forum so I just wanted to vent and let them know that I knew all along they were not real potential client´s.

CIC still requests a VALID and SUBSISTING passport from the applicant(s) approved under H&C factors.
After reviewing your file, it is noted that you have not provided a copy of valid and subsisting passport. Please send it ASAP.
If you are unable to obtain a passport, you must provide a letter from the embassy indicating the reasons why a passport will be not issued.

So try to get one from Kosovo, yup no Embassies yet.
There is nothing CIC can do to force any foreign country to provide a letter why they refuse to issue a Passport.

Yes.
How and where do I obtain one?
If you live in Kosovo
You can apply by sending an e-mail to the following governmental address: info@kosovopolice.com. You should attach a scanned copy of your passport and indicate the period of stay in Kosovo. Or a close family member can apply on your behalf in Kosovo.
If you live outside Kosovo
Close family members or a representative certified by the court or notary can apply on your behalf in Kosovo. Representatives must present a birth, marriage or family composition certificate issued by UNMIK.
