Please help!
First thanks for the good advise. I am currently living in the US and just married a Canadian citizen in October. My wife doesn´t want me to go home because the sponsorship process to Canada from Kenya is 30 months. Can i get a visitor visa or apply for family class from the us, i have a copy of my I-94 and not the original. Is it possible, its really mind boggling...

(in reply to: spousal sponsorship from US) Did you enter the US on a B1/B2 visa? or H1-B?

(in reply to: spousal sponsorship from US) I assume that your I-94 is still valid right?
Here is the problem with the visitor´s visa.
You are asking to apply for a visitor´s visa, BUT you don´t have any intentions of visiting Canada as per say. You want to enter Canada while your immigration process takes place. That is not what a visitor´s visa is for.
If you don´t have a student program to go back for, as soon as your I-94 expires you are required to leave the US so the likelyhood of getting a Canadian VV is very slim to none.
You can start the process in the US if you meet the requirements but once your I-94 is done, you are required to leave the US and your file will be transfer to the Embassy in charge of your region. So either way, you can´t avoid the delay.
Your best option is to apply from your home country and once you obtain your immigrant´s visa then move to Canada.
