Divorce and on work permit

Subject: Divorce and on work permit
  My wife and I live in Canada . I am the principal applicant and my wife dependent on my status . I entered Canada on the skilled foreign worker program and am eligible for permanent residency status as from December 2011 . My wife and I now face possible divorce - if we do get divorced what is her status in Canada ? Assuming I do not submit a renewal of work permit for her - what happens when her work permit expires ?

It is my belief that until the divorce is final, she would still fall under your work permit - and you must be separated for a year before they will grant you a divorce.

Are you intending to apply for PR status? Would the world end if you included your wife or at least give her the option.

If/when you renew your work permit and do not include her, she would be obligated to leave the country unless she can stay on her own merits.

Something in the way you have explained yourself makes me think you want to punish her. You may not believe in Karma but I sure do.
